AGREEMENT FOR RECYCLABLE CONCRETE & ASPHALT DEPOSIT
This agreement is between the City of Bremerton, hereinafter, "City" and Ace Paving
Company, hereinafter, "Ace" to perform materials processing of recyclable concrete and
asphalt materials with credits applied. The City will transport recyclable concrete and
asphalt materials to Ace's facility at the Werner Road site in West Bremerton. The City
will pay Ace $3.75 per ton for materials deposited and be invoiced on a monthly basis.
Ace in return will give the City a credit equal to the same amount deposited, in tons, of
the following products: % minus, I inch minus, I V. minus, I Y2 to I % minus, 2 inch to 4
base, and 4 inch to 8 base. The amount of credit will be sent out monthly. It will be
mailed to Public Works & Utilities, 100 Oyster Bay Ave, Bremerton , Wa 98312,
attention accounting.
This agreement shall automatically be renewed on a calendar basis unless written notice
of termination is given by either party by the proceeding October I of any year. Failure
of either party to notify the other of such termination on or before October I of any such
year shall cause this agreement to automatically be renewed for the next ensuing calendar
year.
Ace agrees to defend, indemnify and save harmless the City, its appointed and elected
officers and employees, from and against any and all liability, loss, cost, damage and
expense, including cost and attorney fees in defense thereof because of actions, claims or
lawsuits for damages from personal or bodily injury, including death at any time resulting
therefrom, sustained or alleged to have risen directly or indirectly out of the
consequences of Ace's performance of this agreement. This agreement constitutes the
entire agreement between the parties and both parties acknowledge that there are no other
agreements, written or oral, that have not been set forth in the text of this agreement.
