The Department of the Navy (Government) desires to obtain water and sewer service from the
City of Bremerton, WA (Contractor) for the certain Navy Base Support Area (BSA) buildings
located in Bremerton, WA. Service shall be as described in the enclosed Technical and
General Provisions, and Water and Sewer Service Specifications. As service charges will not
exceed $100,000.00 annually, a formal contract is not required. The BSA will be charged the
rates as' shown on the attached rate schedule. The effective date and initiation of service under
this agreement shall be 1 December 1997. The following is a list of City accounts which will

The Government will pay invoices that are submitted at the lowest rate schedule available to
any customer under like conditions of service. The Contracting Officer shall be advised in
writing of any changes in applicable rates as is now established under the current City of
Bremerton Ordinance 4578, with a copy of any future rate schedule(s) being sent to the
Contracting Officer at above letterhead address. A connection charge of not -to -exceed $700.00
shall be paid for the sewer connection at Camp Mckean under account number 54-5940-0 and
shall be billed on the first monthly utility bill after the connection is made.
The Government has assigned reference number N68711 -96-M-2292 to this agreement. Please
include this number on monthly invoices and any correspondence. Invoices for services
provided under this agreement are to be forwarded to the following address for certification and

a) This clause applies to the extent that services furnished hereunder are not subject to
regulation by a regulatory body.
b) After thirty (30) day after the acceptance date of this agreement, either party may
request a change in the rates or terms and conditions of service, unless otherwise provided in
this agreement. Rates under this agreement are established by the City of Bremerton Ordinance
4578, and as may be changed by the City from time to time in the future.

c) The effective date of any rate change shall be the effective date of the applicable
City ordinance. The Contractor agrees that throughout the life of this agreement the rates will
not be in excess of published and unpublished rates charged to any other customer of the same
class under similar terms and conditions of use and service.
d) Any changes to rates, terms, or conditions shall be made a part of this agreement by
the issuance of a contract modification.

The City and the Navy mutually agree, upon the effective date of this agreement, that contract
numbers N68711 -83-C-9720 and N68711 -85-C-6913, as amended, which has provided the
Navy similar services, is hereby superseded with regard to the BSA accounts, as listed in other
parts of this agreement, and the City further agree to unconditionally waive any claim against
the other by reason of such termination, except for service billings due or to become due.

TECHNICAL AND GENERAL PROVISIONS
PAYMENTS
The Contractor shall be paid for water and sewer service provided to the Base Support Area
buildings at the rates specified in the approved City of Bremerton municipal water and
wastewater services, Ordinance 4578.
Payments shall be contingent upon the availability of funding and shall not be made in advance
of the services rendered.
All monthly bills shall be paid in accordance with the Prompt Payment Act, FAR 52.232-25.
The Government shall be entitled to any discounts customarily applicable to payment of bills by
all customers of the Contractor.
RATES AND CHARGES
For all service furnished under this agreement to the service location the Government shall pay
the Contractor at the rates established and approved by the City of Bremerton. The applicable
water rate shall be based on the appropriate meter size for the account, and the wastewater
sewer) rate shall be based on the City's Commercial I rate.
Average estimated monthly cost of service is:
Monthly Water Cost: $700.00
Monthly Sewer Cost: $250.00
Total average estimated monthly Cost: $950.00
CHANGE OF RATES
No increase shall be requested in the agreed to water and sewer service rates unless the
Contractor has increased rates to all of its customers under similar conditions of service. If the
Contractor has decreased rates, a corresponding rate decrease in agreement rates shall be
made.
OWNERSHIP, OPERATION, AND MAINTENANCE OF FACILITIES
The facilities supplied by the Contractor under this agreement shall remain the property of the
Contractor and shall be operated and maintained by the Contractor. The Government shall
own, operate and maintain the water and sewer lines on Government property.
PERMISSION TO ENTER SERVICE LOCATION
The Government hereby grants to the City of Bremerton (Contractor) its agents and employees,
free of any rental or similar charge, but subject to the limitations specified in this agreement, a
revocable permit to enter the service location for any proper purpose under this agreement,
including use of site or sites agreed upon by the parties hereto for the installation, operation and

maintenance of the facilities of the Contractor required to be located upon Government
premises. Authorized representatives of the Contractor will be allowed access to the facilities
of the Contractor at suitable times to perform the obligations of the Contractor with respect to
these facilities.
It is expressly understood that the Government may limit or restrict the right of access herein
granted in any manner considered to be necessary for the national security. However, the
Contractor shall not be held in breach or default of this agreement or be penalized for failure to
provide service hereunder should this right of access be so limited or restricted by the
Government to the extent that the Contractor cannot perform.
CHANGE IN VOLUME OR CHARACTER OF SERVICE
a) The Contracting Officer shall give reasonable notice to the Contractor respecting any
material changes anticipated in the volume or characteristics of the Utility Service to be
delivered. It is the responsibility of either party to notify the other of any change in the levels
of discharge (Government) or services (Contractor) by giving six (6) months advance notice in
writing.

WATER: The City shall have water continuously available at the points of delivery at a
pressure not less than applicable State standards. The City shall supply clear, potable water safe
for human consumption in accordance with standards adopted by the United States Public
Health Service for drinking and culinary water supplied by common carriers in interstate
commerce and such revisions thereof as may be made from time to time.
SEWER: The City shall furnish sewage service as provided herein and shall receive, carry,
treat and dispose of all sanitary sewage originating at the delivery point in such amounts as
governed by the estimated volume and rate delivery specified herein, and in a manner and by
such means as will constitute no hazard to the public health. The City shall operate their
sewage facilities in conformity with applicable laws, rules, and regulations promulgated by
Federal, State and local authorities.

This modification is issued to add the Parking Garage located at 400 Park Avenue, Bremerton, WA for Sewer
service, effective 02 December 2005. A correction of the description for account number 13-0258-0 and the
inclusion of the rate charges for both water accounts in modification P00009 are addressed under item 2 below.
1. Wastewater that includes water runoff from vehicles and water from the hose bibs that are used for
cleansing garage floors 1 (one) through 5 (five) of the parking garage drains through a government installed oil
water separator then into the City of Bremerton sanitary sewer
The applicable sewer service rates for the garage wastewater is Commercial I, within City Limits and includes a
base charge and a commodity charge (per HCF). The sewage commodity charge is calculated based on metered
water usage.

Bremerton, WA (Base Support Area) This CLIN is established to add Navy
properties on the periphery of the Shipyard/Naval Base Bremerton that directly
contribute stormwater to a City -owned and maintained stormwater collection
system. Monthly rate will be based on the amount of impervious surface units
ISU) contributing run-off to City collection systems. One ISU is equivalent to
2,500 square feet. The rate for one ISU is $8.03/month. The three areas being
added to the contract are: (1) Craven Center located on the NW corner of Burwell
Street and Park Ave. It has an area of 175 x 105 feet of impervious area or 7.35
ISUs and will be added to account 1301760. (2) The Navy Parking Garage
located on Park Avenue, between 4th and 5th streets has two areas, a 300' by 185'
and a 70' by 70' impervious area. There is landscaping in this area that accounts
for 23 ISUs and therefore the total Parking Garage accountd for 24.16 ISUs and
will be added to account 1302580. (3) The Navy property located south of Rodgers
Street between Charleston Blvd. and S. Callow Ave. This property is 440'x 200'
or 35.2 ISUs and will be added to account 2502301.
Per mutual agreement of parties during negotiations held March 2008, all
stormwater rates are effective retroactively to 01 December 2007.
Future adjustments of rates will be in accordance with Bremerton Muncipal Code
15.06, Assessments, Rates, Fees and Charges, as may be amended.
