RE: (;y As you recount in your letter, previous zoning for this site was B-3 per City Ordinance #3915. In this rezone, a twenty foot green belt was required along the southern border of the site. In the 1988 revis ion of the Ci ty Zoning Ordinance, this condi tion, as required by Ordinance #3915, ceased to exist. In its place, are the standard specifications per the City's landscape guidelines and other such requirements in the Zoning Ordinance. In addition to the condition Zoning Ordinance when this site was earlier zoned to B-3, the City also required that a concomitant agreement between the City and owner be signed and filed. This concomitant agreement was not quieted by adoption of the new Zoning Ordinance. It is, however, the determination of the planning and legal staff of the City that if a property owner has not developed his/her land pursuant to the concomitant agreement, then that owner has not vested any rights under that agreement. When the new Zoning Ordinance was adopted, the concomitant agreement became null and void since development did not occur under the concomitant agreement conditions. Please advise your prospective buyer to review the new Zoning Ordinance and the setback and landscape requirements within it.
