WITH THE JOHNSTON GROUP FOR FEDERAL LEGISLATIVE/ AGENCY
REPRESENTATION SERVICES: Public Works & Utilities Director Tom Knuckey stated that in
January 2019 the City executed a Professional Services Agreement with the Johnston Group to
assist with federal lobbying and to help build collaborative working relationships with federal

Dear Council,
I urge you to vote NO on the Lusignan Forestry Contract, Item A4 (Consent Agenda). It does not make sense
economically or ecologically.
This five-year contract harvests 2.5million board feet per year from 8400 ac. watershed, with Lusignan getting 5%
of gross profits. This means they have huge incentive to harvest the most valuable trees, aka the oldest trees. City’s
average annual revenue from timber harvest is $650K. This is totally not worth it compared to the benefits of an
intact forest for our water quality and the climate crisis, not to mention a haven for wildlife and passive recreation.
In 2021 alone, City got much more than that from permit fees increases.
Let’s table this contract and consider it again later. Apart from revenue loss, more than compensated for by permit
fees in 2021, what harmful impacts would ensue? Whereas these old trees cannot be brought back in our lifetimes.
The thin soil of a PNW forest washes easily away. The network of root support does not snap back. The climate
crisis is here already. Large tracts of undisturbed forests won’t reverse the crisis, but they will mitigate it by
producing oxygen, moderating runoff surges through stemfall and throughfall, reducing erosion through undisturbed
root networks, and much more.
Best available science states that roadless forest provides the greatest benefits for clean water supply in our area.
BAS also states that roads harm forests even more than clear-cutting. What ecological report assessed the costs and
benefits of cutting down so many old trees, and concluded that the benefits outweighed the costs?
Who assumes the associated costs of building roads for timber extraction, erosion control of said roads post-harvest,
monitoring and oversight, and what are those costs? How many hours will Forestry Manager Cami Apfelbeck and
staff work in directing Lusignan? Because those person-hours reduce the profits stated in this contract.
Our clean water is a byword, an attraction, and a significant source of revenue. Let’s not threaten it for a quick
profit.
Thank you for your attention to this matter. And I apologize for contacting you so late in the process.
Yours,
Anna Mockler

Dear City Council;
I write in response to the proposed contract and vote, item A4, of the Agenda.
In gathering scientific data with very limited time, I presented this situation to my brother,
Nathan Hale, a Senior Project Manager and Staff Ecologist for Live Oak Associates, an
Ecological Consulting Firm in San Jose, CA. Collectively, we created the list of points to
consider below before voting on this contract:
Was an environmental impact report completed and shared with the council?
Is this going to be certifiable sustainable harvesting?
Will there be restrictions on how large trees that are harvested can be, so that the
largest trees won't be cut?
How will they deal with slash?
WIll they replant?
What species will they replant?
Will those replanted species be watershed-specific planting stock (i.e., contract grown
from locally collected seed) and appropriate to the locations they are being replanted
in?
Who will provide oversight to make sure they are doing what they are supposed to be
doing?
What protected species occur there and have they been permitted for?
Has anyone considered the cumulative impact to ecosystems of this project with
other projects in the vicinity?
Another thought, who is responsible to fight wildfires in that tract of land after
Lusignan gets to rip into it? Does that come from tax-payers? How much is that
predicted to cost?
Can we make Lusignan set aside money for fire-fighting on that land during their
lease and for a reasonable time after their lease ends to ensure they are harvesting
in a way that supports ecosystem-sustainable and a fire-safe approach to logging and
to ensure the City doesn't come out in the red in the end?
Carbon sequestration happens at a much higher rate for larger trees than small trees;
killing and milling trees leaves plenty of the tree to be used in carbon releasing ways (e.g.,
decomposing mulch, burning of slash for power generation, etc.) to be fair, building with
wood stores that carbon long term in the building, but that's going to be less than half of the
tree volume. Also, dead trees no longer suck up atmospheric carbon. So... what is the
value of the carbon that will decompose? And what is the lost value of the lost carbon
storage capacity of those trees that will no longer be storing? Who is going to not only
consider the costs of this, who’s going to pay for that?If ANY of these questions are without
an answer, we should not consider moving ahead with this approval.
In utilizing this forest to sell trees to offset the cost of water filtration and management, let’s
also consider the benefits these trees have to our water tables. I’ve taken information from
the World Resources Institute, “3 Surprising ways water depends upon our forests” for your
information and consideration.
1. The Quality of Water
Erosion—when rainfall, runoff or wind detach soil particles—is a significant problem that
affects both water quality and quantity.
Healthy forests act as a filter to keep pollution out of water. Strong roots anchor soil against
erosion and material on the forest floor helps absorb nutrients and sediment. But when
forests are disturbed and degraded, sediment flows into streams and pollutes water.
In the early 2000s, Colorado experienced wildfires that degraded forests along the Front
Range. Extreme ash and debris from the fires made its way into key waterways, forcing
Denver's water utility, which serves 1.4 million people, to temporarily rely upon back-up
reservoirs. Cleaning up this erosion alone cost Denver’s water utility $26 million.
2. The Availability of Water
Forests help control the water cycle by regulating precipitation, evaporation and flows.
Layers of forest canopy, branches and roots can store and release water vapor, which
controls rainfall. Forests can also help reduce the impacts of flood from storms by blocking
and slowing down the flow of runoff.
Deforestation weakens this process, leading to irregular rainfall patterns including drought
and flooding.
While deforestation may occur locally, its effect is global. According to Greenpeace,
deforestation in Central Africa could decrease rainfall in the U.S. Midwest by 5-35 percent.
Texas alone could see a 25 percent decrease in rainfall after Amazon deforestation,
affecting agricultural productivity and other sectors.
3. The Cost of Water Treatment
Communities often rely on expensive water filtration infrastructure to ensure clean water.
This cost often increases when erosion deteriorates water quality.
Relying on natural infrastructure like forests, as a complement to traditional built
infrastructure, is proven to reduce water management costs and provides both economic
and cultural benefits like recreational green spaces and fish and wildlife habitats.
New York City, for example, conserved forest and natural landscapes in the Catskills to
save on water filtration costs. The city invested $1.5 billion to protect more than 1 million
acres of mostly forested watershed area, ultimately avoiding $6-8 billion on the cost of
building a water filtration plant.
In summation, not enough research has been done to vote on this contract. This decision
would cost FAR more than the temporary reprieve the community may receive from the
sale of this forested watershed. I urge you to consider our local watersheds, our
community, our children, your lasting impact, and vote NO.
Thank you,
Erinn Howell

I wish to express my utter horror that more Forest is being sacrificed immediately adjacent to our
unparalleled watershed. We should, instead, be seeking to preserve and extend the living,

that can never be replaced.
I walk almost daily at Pendergast Park. I am astounded by the amount of wildlife I see. But they are
struggling too, due to this type of activity. The coyote were driven down to the park by the latest
housing development, which also impacted the watershed. There are beaver struggling to exist
below the park, who are almost continuously interfered with by humans (not withstanding the
recent restoration work done). There are deer, river otter, bear, heron, Pileated woodpecker…
There is a tremendous store of awesome native plants.
This special place is a great treasure we should horde for our children’s children. It is a large part of
why this city itself is so special.
Please do not destroy our Forest.
Sincerely and with hope,

Dear Council Members,
I am alarmed and dismayed to hear that you are planning to give the okay to log off 20+ acres of our
beautiful and important trees in the Bremerton Watershed! I am pleading for you not to do this for the
sake of our water quality, air quality and habitat for wildlife in the watershed.
May I remind you of what is written on the Bremerton Watershed website, “watershed protection is the
first and most critical step to ensure a safe water supply. It is much healthier, easier and
environmentally sound to protect water quality to begin with than to treat it and remove contaminants
after the fact.” You will not have water quality if you log the trees!
You may say that it is only 20+ acres, but I differ. Once you bring in the big machines, the damage is
forever done. The soil is damaged, the sediments that run-off will make their way into the water that
you are saying you are here to protect.
With rapid development and increasing population growth in Kitsap County, we need our mature trees
more than ever before.
Please keep the Bremerton Watershed as it was meant to be for now and in the future.
Sincerely,
Sue DeArman

Hi,
Anna Mockler has brought up quite a few points on the logging contract that I found disturbing or at
least worthy of further study.
Especially considering the big turnover of Councillors that will happen in January, I think it would be
beneficial to postpone the ratification of this contract until new members are installed.
Thank you.

Dear Cami,
Per the USFS, laminated root rot "is nearly ubiquitous throughout most Douglas-fir and grand fir forests
in Oregon and Washington”. … “Douglas-fir, mountain hemlock, grand fir, and white fir are often killed.
Other tree species vary in susceptibility and degree of tolerance (Table.fid-2). Hardwoods are immune.”
… “Once infected trees die, the fungus continues to live on-site as a saprophyte in small roots for 8 years
or more, and in large stumps and large roots for as long as 50 years.” … “Laminated root rot usually
intensifies when infection centers and adjacent areas are regenerated with highly susceptible species.”
… “Ground fire severity may increase as a result of the abundant down wood in infection areas.
On recreational and administrative sites, forest work sites, and along roadsides, trees with laminated
root rot have a high potential for failure and can present a significant safety
hazard.” https://apps.fs.usda.gov/r6_decaid/views/laminated_root_rot.html
In short, it’s everywhere, it provides great wildlife habitat, and replanting to Doug fir, as called for in the
FPA, will actually intensify it. Canopy cover opens up as trees fall down, creating areas perfect for
replanting to hardwood natives like big-leaf maple, red alder, etc.
While groundfires may worsen, it appears that threat is true wherever it’s present, and it’s present
throughout our area.
Let me say that I do NOT consider myself an expert on this root rot just because I read one article. But
the USFS doesn’t seem too worried about it, unless you’re managing timber for market.
Yours,

Subject:RE: Lusignan Forestry
Good morning, Anna:
Here are the responses to your questions.
Kind regards,
1)How does clear-cutting 20.3 ac of 70-year-old trees, directly above the reservoir, contribute to the
stated goal: "To maintain the units in a sustainable productive forest while providing for water quality,
fish and wildlife habitat”? The current stand of forest in the Union River Watershed is the product
of natural re-growth after the complete loss due to fire in the 1930’s. This resulted in single-
species dominance (predominantly Douglas Fir) w/relatively little species diversity. Further, the
trees are predominantly the same age, and spreading pockets of Laminar Root Rot have been
identified. These factors make the forest particularly vulnerable to climate change and less
resilient to fire.
Careful, focused units of harvest allows for the diversification of species, age, and habitat and
the removal/control of disease. Thinning further reduces competition and allows for healthy,
robust growth, leading to healthier habitat. Overall, this promotes a healthier more resilient
forest.
Any harvest activity in the watershed is provided special oversight and scrutiny and conditioned
with operational constraints and environmental protections that exceed those required by the
Forest Practices Act and Forest Practices Application.
2)Item #19, p. 5 of 9 in the Forest Plan, calls for harvest of 97% of the area (i.e., clear-cut), with a yield
of 480 mbf (thousand board feet) — please clarify. The presentation of this contract to Council called for
removal of 2.4M (million board feet) per year, the figure I used in previous correspondence.I apologize
for the confusion here. The agenda bill background information section is intended to give the
Council and the public a summary of the overall program and how the particular consultant was
selected. Specifics about the contract are detailed in the contract itself. EXHIBIT B Fee
Schedule explicitly states “The City of Bremerton does not warrant or guarantee any
specific level of harvest or income with this agreement. Harvest levels, if any are entirely
the decision of the City of Bremerton.”
The sustainable harvest level was calculated to be, on average, 2.5 million board feet per year.
However, this is not the driver that dictates the level of harvest that occurs eachyear (though it
does set an upper limit on average to ensure that we are protecting sustainability). Other criteria
determine where, when, and how much. Harvest levels (particularly, since 2010) have been
significantly less.
My presentation tonight will dive a little deeper into the selection criteria and harvest statistics.
3) The contract was described as being with Lusignan Forestry, who have performed this work for 11
years. The final page of the Forest Plan, Notice of Transfer of Forest Practices Application/Notification. is
signed by Eric Hurd, dba Hood Canal Logging. Please explain the discrepancy. Hood Canal Logging is
Lusignan’s subcontracted harvester.
4) May I conclude that the Forest Plan comprises all of Forestry’s directions to Lusignan? Because I
requested Forestry’s directions to Lusignan on what, where, when, and how to cut, and was sent the
Forest Plan. A copy of the Forest Practices Application (FPA) for harvest unit Inside 55was
provided as an example of the directives to Lusignan specifically in regards to harvest activity.
Lusignan must conduct activities explicitly in compliance with the approved FPA. Depending
upon the particular unit (for example, any unit within the Union River Watershed), the City gives
additional directives regarding operational constraints and environmental protective measures
above and beyond what is required and reflected in the FPA. These directives are delivered and
discussed at an initial meetingwith Lusignan (and any subcontractors) once the FPA is
approved and prior to any activity. Each harvest unit has its own FPA, so these directives will
vary for each unit. The City supervises activities in progress and may choose to submit an
amendment tothe FPA and/or provide additional directives depending upon the circumstances.
Directives regarding other contractual obligations such as communications, invoicing and
reporting are detailed in the contract.
5) On p 11 of the Forest Plan, the Forest Practice Activity Map shows a stream, per the map legend and
per the icon depicting a stream crossing. The stream is water-typed A: Ns (non-fish seasonal stream)
Does this rainy season stream feed the reservoir? Yes. This is a seasonal stream that has not been
identified in state mapping and, therefore, not required to be addressed by the FPA. However,
the City identified the drainage course as part of the pre-application site inspection/survey and
chooses to include it. Further, as is standard practice with any activity in the watershed, the City
voluntarily imposes additional protections (sediment and erosion control, buffers, etc.) to ensure
protection of the drinking water. These measures have been proven effective during previous
harvest of this unit with no impacts to the reservoir.
6) This is a ten-year statement of intent — what are future plans for similar timber harvest? Each
timber harvest unit will have its own FPA with associated 10-year statement of intent. This is
DNR’s insurance that each unit will be reforested.
As far as comprehensive policy governing utility land and forest management, that conversation
will begin in 2022 with the update to the Utility Land Management Planand the Forest Land
Management Plan. In keeping with past practice, this will be a public process soliciting
publiccomment and input and ultimately going to the Council for Council acceptance.
7) The Forest Plan reports numerous trees >32”dbh, with others measured as >42”dbh. Since no survey
was conducted, per this document, were these particularly large trees accessible from the network of
roads? You are referring to information provided in the Marbled Murrelet Form. To clarify, the
“survey” to which this form refers, is a detailed survey required if the initial harvest area
inspection/survey by the City identifies qualifying Marbled Murrelet habitat. As our initial survey
did not identify qualifying habitat, we were not required to conduct the detailed survey. However,
we are required to provide the general stand conditions including species, age, and max size
identified in our initial survey.
The initial harvest inspection/surveys are conducted on foot, so these trees were identified and
measured as part of that survey.
8) Since no survey was done, how was it determined that planting exclusively Doug fir would replicate
the diversity of existing forest, upon which a diversity of wildlife habitat depends? Again, the City does
conduct an initial site inspection/survey to identify unit characteristics. As it is predominantly
Douglas Fir at this time, it is known that reforestation will include Douglas Fir and so it is listed in
the FPA. However, the City can and does go “above and beyond” FPA requirements, including
reforestation with additional species. By not explicitly stating additional species, it allows us the
flexibility to select based upon conditions discovered on site during the harvest. For example, if
areas of root rot are discovered, we would not replant Douglas Fir in those areas. Rather, we
would select aspecies less vulnerable to root rot and more specifically tailored to the soil
conditions onsite.
9) The Scope of Work appears to state that the City pays L&I for Lusignan Forestry employees, which is
about the highest L&I rate there is. Can you tell me what this L&I is projected to cost for this contract?
The City does not provide insurance to contractors/consultants. It is explicitly written in Section
VI that the consultant/contractor must procure and maintain all insurance and provide proof of
said insurance. The only reference to insurance in the Scope of Work that I can see refers to
the Loggers Broad Form insurance coverage required to be carried by any subcontractors. It is
required that the City be named as an additional insured party to provide protection to the City
from any work done by subcontractors to the consultant, but the City does not pay for that
insurance.

Thank you, Tom. Who is the City’s forester?
I wasn’t certain any of you could answer all my questions inside 48 hours! But I am certain that it’s fair &
respectful to submit them to you as soon as possible. I’m not at all interested in blindsiding any of you in
the middle of a Council meeting.
Yes, I do know that our watershed’s surface water supplies most of our drinking water. I listened with
great interest and attention to Cami’s presentation on 26 May of this year, especially that portion which
described measures taken to avoid constructing and maintaining a filtration plant.
Thanks also for all of the information about the City’s sustainable harvest plans. I guess my point is that
our watershed forest should be managed for water quality and fish & wildlife habitat, as specified in the
Forest Practices Application, and not for marketable timber.
One thing I love about Bremerton is that we can have differing viewpoints while maintaining respectful
discourse.
Take care, and stay as dry as possible,

Good afternoon Anna – I’m not a forester and so I’m unable to quickly respond to your various
questions. That said, I want to assure you that we have a shared interest in maintaining the health of
our 8,400 Acres of forested utility lands and watershed, and our approach will be the topic of Cami’s
presentation at Council tomorrow night. I’m not sure whether you’re aware, but approximately 2/3 of
our drinking water comes from the surface supply in our watershed, and our number 1 priority in how
we approach forest management is to ensure we maintain the exceptional quality of our drinking
water. This can only be done if the forest is healthy, and so forest health is the cornerstone of our
approach to forest management.
Specific to our sustainable harvest plans, I wanted to let you know that all harvest areas are identified by
the City’s forester, who himself previously worked for DNR as a Forest Practices Forester (regulator). I
also wanted to let you know that we intend to update our Utility Lands and Forest Management Plan
beginning next year. This plan was originally developed in the 1980’s and last updated in 1996. The
plan was developed with input from an Advisory Committee and established best management
practices, including annual sustainable harvest levels for forest lands - we intend to follow this model as
we update the plan beginning next year. My understanding is that we’re currently harvesting at levels
below those identified in the plan, and assuming an average of 40 Acres on an annual average basis, this
equates to less than 0.5% of our forested lands each year.
I do look forward to the presentation tomorrow night and hope everyone will come away with a better
understanding of our approach to forest management.

Dear Dirs Apfelbeck & Knuckey,

Therefore, I request that you postpone this item until the requested materials can be delivered.
ecological value of intact forest for our water quality outweighs any
profit from harvesting. The economic value may outweigh the net profit as well Once you subtract costs of
road maintenance, erosion control, staff hours, brush cutting, monitoring & oversight, etc., it seems quite
possible that the net profit will be much smaller than it appears.

Obligations include reforestation, road maintenance and abandonment plans, conversions of forestland to non- forestry
use and/or harvest strategies on perennial non-fish habitat (Type Np) waters in Eastern Washington.
Before the sale or transfer of land or perpetual timber rights subject to continuing forest and obligations, the seller must
notify the buyer of such an obligation on a form titled ÐNotice of Continuing Forest Land ObligationÑ. The seller and buyer
must both sign the ÐNotice of Continuing Forest Land ObligationÑ form and send it to the DNR Region Office for retention.
This form is available at DNR region offices.
If the seller fails to notify the buyer about the continuing forestland obligation, the seller must pay the buyerÓs costs related
to continuing forestland obligations, including all legal costs and reasonable attorneysÓ fees incurred by the buyer in
enforcing the continuing forestland obligation against the seller.
Failure by the seller to send the required notice to DNR at the time of sale will be prima facie evidence in an action by the
buyer against the seller for costs related to the continuing forestland obligation prior to sale.
