SUMMARY: In June of 2019 the City created BMC Chapter 6.20 titled "Carryout Bags" which
imposes restrictions on the use of single -use plastic bags. In March of 2020 the State Legislature
created RCW 70A.530 that imposes similar restrictions on the use of single -use plastic bags which
preempts BMC Chapter 6.20. RCW 70A.530 further prohibits municipalities from enacting local
carryout bag ordinances. For compliance with the RCW staff recommend the City Council repeal
Chapter 6.20 of the Bremerton Municipal Code titled "Carryout Bags".
