Executive Memo – Cingular Wireless Alexander Lake West
ATC Telecommunications Tower Lease Renewal
Date: June 15, 2021
Description: The current Cingular Wireless Telecommunications Tower Land Lease number
4566 in the City of Bremerton contract portfolio was scheduled to expire 7/5/2021 and
included an initial term of five (5) years and one (1) renewal term. In 2012 there was an
extension of the initial term making it expire in 2016 but still allowing for 1 renewal term
bringing us to the 7/5/2021 expiration. Upon reaching out to Crown Castle, the management
agent for Cingular Wireless, they produced a different executed copy of the agreem ent
showing that there was an initial term of 5 year but with renewal options allowing up to 25
years effective 7/5/2006 making the new expiration date 7/5/2031. Reconciliation and legal
review of the two agreements has resulted in agreement with Crown Ca stle that the intent of
the agreement was for a 25 year term. This was reached, due to approval from the Mayor at
the time, Cary Bozeman signing the MOU which stated I had 25-year term. Further, the City
Council approval stated that it had a five-year term but did not address the renewal options
making it applicable to either version of the agreement.
Fiscal Impact The current agreement has monthly lease rent at $1868 monthly which is
comparable to the other towers in the nearby vicinity with rents of $2 046 and $1837.
