At that time the proponent disclosed his intent to develop 85 units on the property which was rezoned. Although no zoning conditions specifically addressed the number and location of buildings, the public hearing process fully disclosed the project intention for 85 units. During 1988, further Planning Commission and City Council hearings regarding a right-of-way vacation adjacent to this site disclosed the project intent to develop a maximum of 85 units on the site. These hearings also disclosed the location and configuration of a third building in roughly the same site as proposed by this subject building permit application. The right- of-way hearings vacation was integral to side development of building 3. Sewer and water hook-up permits were applied for and granted specifically for the project inclusive of this third building. The sewer and water permit documentation does not include additional buildings to develop to full capacity of 85 units. It is upon review of this evidence that I find a full public disclosure and public expectation of building number 3 to be built and I find that the failure to submit a substantially completed building permit application by November 11, 1988, to have been an inadvertent error in the development process. Based on these findings, I conclude that building number 3 is vested under the old zoning ordinance and as such is not required to be processed through the planned unit development process required by the new zoning ordinance.
