MERRICK DAVID L. o[ COURCY SUZANNE E. OLIVER ASA .GLAZER J ERRET E. SALE B RUCE G. LAMB TYNA EK DINAH C. POMEROY NANCY K. MCCOID DAVID HOUSTON REEVE Today we traveled to Kitsap County Superior Court in Port Orchard to argue the City of Bremerton's Motion to Dismiss before Judge Kruse. JucgP Kruse.granted our motion and dismissed all of the claims against the City. We had to wait most of the morning before our case was called to be heard. The motion was opposed by William Mc- Gonagle on behalf of the plaintiff,•William Smart on behalf of defendants Boat Shed and Hayfields, and an attorney from Dunlap, Fallon & Soderland, on behalf of defendants Buskirk & Weeks. Defendants Boat Shed & Hayfields brought and argued a cross -motion for judgment of contingency liability on the part of the City of Bremerton if the existence of the step was found to violate the city's building code. We argued that none of the allegations against the City of Bremerton alleged any breach of duty by the City which could be a basis for a tort claim. We argued that the Bremerton City Building Code created a duty on the part of the City running only to the public as a whole and not to any of the individual claimants. Our opponents argued strenuously that the case of J & B Development Company was on point and held that a local government could be held liable for its negligent Mr. Ray Moon May 20, 1986 Page 2 failure to enforce its own building code. We argued that the J & B Development Company case involved a different set of facts and was not persuasive in our case. We are in the process of preparing an order for the judge to sign. When this order is entered we will see if any of the other parties plan to appeal. If not, then we can proceed to close this file. Very truly yours, Bruce G. These rules become effective 60 days from publica- tion.. An integral part of the Corps regulatory program is the concept of general permits for minor activities. General permits are activity and/or area specific and are designed to relieve some of the administrative burdens associated with permit pro- cessing for both applicants and the Federal Government. The nationwide permits found at 33 CFR 330.5(a) are a form of general permits issued by the Chief of Engi- neers and are intended to apply throughout the entire United States and its terri- tories. A listing of the nationwide permits and special conditions is attached. The nationwide permit found at 33 CFR 330.5(a)(26) requires that the permittee notify the district engineer at least 20 days prior to performing the discharge, if the discharge will cause the loss or significant adverse modification of more than 1 acre of waters of the United States (including wetlands). Specific procedures for this pre -discharge notification are contained in 33 CFR 330.7. Section 330.12 of the final rule contains a Grandfathering Clause in order to avoid unreasonable impacts to permittees whc may be conducting activities under the nationwide permits prior to the effective date of these changes. These activities may continue under the authority of the previously existing nationwide permits pro- vided that: a. The activity will be completed within 18 months from the effective date of this rulemaking, b. The division engineer has not previously exercised his discretionary authority under Section 330.8 of the rules, and, c. Modification, suspension, or revocation procedures have. not been initiated under 33 CFR 325.7. Permittees who cannot comply with these criteria are required to conduct their activities in accordance with the reissued nationwide permits. The nationwide permits provide a simplified, expeditious means of project autho- rization under the various authorities of the Corps of Engineers. We encourage prospective permit applicants to consider the advantages of nationwide permit authorization during the preliminary design of their projects. Assistance and further information regarding all aspects of the Corps of Engineers regulatory program may be obtained by contacting* 6 U.S. Army Corps of Engineers Seattle District Regulatory Branch Post Office Box C-3755 Seattle, Washington 98124 telephone (206) 764-3495 Atch Nationwide Permits Contained in 33 CFR 330.5 The following is a list of the nationwide permits, authorized by the Chief of Engineers, and published at 33 CFR 330.5. (13) Bank stabilization activities provided: (i) The bank stabilization activity is less than 500 feet in length; (ii) The activity is necessary for erosion prevention, (iii) The activity is limited to less than an average of 1 cubic yard per running foot placed along the bank within waters of the United States; (iv), No material is placed in excess of the minimum needed for erosion protection; (v) No material is placed in any wetland area, (vi) No material is placed in any location or in any manner so as to impair surface water flow into or out of any wetland area; (vii) Only clean material free of waste metal products,, organic mate- rials, unsightly debris, etc. is used; and (viii) The activity is a single and complete project. (Sections 10 and 404 ) (14) Minor road crossing fills including all attendant, features, both tem- porary and permanent, that are part of a single and complete project for cross- ing of a non -tidal waterbody, provided that the crossing is culverted, bridged, or otherwise designed to prevent the restriction of, and to withstand, expected high flows and provided` further that discharges into any wetlands adjacent to the waterbody do not 'extend 'beyond 100 feet on either side of the ordinary high water mark of that waterbody. A "minor road crossing fill" is defined as a crossing that involves the discharge of less than 200 cubic yards of fill mate- rial below the plane of ordinary high water. The crossing may require .a permit from the U.S. Coast Guard if located 'in'navigable waters of the United States. Some road fills may be eligible for an exemption from the need for Section 404 permit altogether (see 33 CFR 323.4). District engineers ,are authorized, where local` circumstances indicate the need, to define the term "expected high flows" for the purpose of establishing applicability of this nationwide permit. (Sections 10 and 404) 3 (15) Discharges of dredged or fill material incidental to the construction of bridges across navigable waters of the United States, including cofferdams, abutments, foundation seals, piers, and temporary construction and access fills provided such has been authorized by the U,S, Coast Guardas part of the bridge permit. Causeways and approach fills are not included in this nationwide per- mit and will require an individual or regional Section 404 permit. (Section 404) (16) Return water from an upland, contained dredged material disposal area (see 33 CFR 323.2(d)), provided the state has issued a site specific or generic certification under Section 401 of the Clean Water Act (see also 33 CFR 32592(b)(1)). The dredging itself requires a Section 10 permit if located in navigable waters of the United States, The return water or runoff from a con- tained disposal area is administrat3.vely defined as a discharge of dredged material by 33 CFR 323.2(d) even though the disposal itself occurs on the upland and thus does not require a Section 4011• Permit. This nationwide permit satisfies the technical requirement for a Section 404 permit for the return water where the quality of the return water is controlled by the state through the Section 401 certification procedures, (Section 404) (17) Fills associated with small hydropower projects at existing reservoirs where the project which includes the fill is licensed by the Federal Energy Regulatory Commission (FERC) under the Federa' Power Act of 1920, as amended; has a total generating capacity of not more than 1500 kW (2,000 horsepower); qualifies for the short -form licensing procedures of the FERC (see 18 CFR 4.61); and the district or division engineer makes a determination that the individual and cumulative adverse effects on the environment are minimal in accordance with Section 330,7(c)(2) and (d). (Section 404) (18) Discharges of dredged or fill material into all waters of the United States other than wetlands that do not exceed ten cubic yards as part of a single and complete project® (Sections 10 and 404) (19) Dredging of no more than ten cubic yards from navigable waters of the United States as part of a single and complete project, This permit does not authorize the connection of canals or other artificial waterways to navigable waters of the United States (see Section 33 CAR 322<5(g)). (Section 10) (20) Structures, work., and discharges for the containment and cleanup of oil and hazardous substances which are subject: to the National Oil and Hazard- ous Substances Pollution Contingency Plan, (40 CFR 300)9 provided the Regional Response Team which is activated under the Plan concurs with the proposed con tainment and cleanup action, (Sections 10 and 404) (21) Structures, work discharges associated with surface coal minine, IJJ Olt 1cpal-CLuenc of Me Interior, Office of Surface Mining, or by states with approved programs under Title V of the Surface Mining Control and Reclamation Act of 19770, the appropriate dis trict engineer is given opportunity to review - Title permit -1 - pplic tin {.. • • - .. MAYOR GENE LOBE to June 8, 1987 letter restoration of structure at 101 Shore The f ollowing responds to your letter dated June 8, 1987 regarding the restoration of the existing structure adjacent to the Boat Shed Restaurant. Because the site has undergone a shoreline substantial development permitting process in 1980, there is a question as to what would be entailed to refurbish and use the building in question. Currently, the Bremerton Shoreline Master Program does not allow construction over the water for commercial structures except for marine or public access uses. Because the structure was constructed prior to the 1977 adoption of the Shoreline Master Program and quite likely before the Shoreline Management Act of 1971, the building and its associated deck are legally non- conforming, However, the burden of proof for establishing a Legal non -conformity is upon the party asserting such status. Once this has been established, the Shoreline Master Program states that legal non conforming structures may continue to exist. In addition, the "repair, restoration and maintenance are permitted. Structural alteration and expansion are permitted subject to approval of a shoreline conditional use permit. °' The ordinance states ...a conforming use is permitted to occupy the structure", a restaurant is a permitted conforming use. Gateway to the Olympics and Home of the Puget Sound Naval Shipyard Mr. Brett Hayfield/Boat Shed Restaurant June 24, 1987 Page 2 In summary, the repair and maintenance of the existing structure is permitted and does not constitute substantial development. Exterior expansion and alteration can be accomplished subject to a conditional use permit. The project as proposed is subject to the review and interpretation of a completed building permit application, and as described in an accompanying Environmental Checklist. This permit was approved by the City of Bremerton on March 6, 1980. The purpose of the permit was to allow the remodeling and addition to the dining area and lounge of the Boatshed Restaurant. As you will note on page 2, three conditions were attached to the granting of this permit. The second condition relates to the repair or replacement of the stairway leading to the leased parking area on Winfield. I have attached a report from the City Engineer which reports on the current condition of the stairs and the needed repairs. The City Engineer has no indications that the work required by the shoreline permit was undertaken. By way of explanation of who within the City has responsibilities for this issue, the Planning Department has responsibilities for enforcing the zoning ordinance, the building ordinances, and the shoreline permit system. The Engineering Department has responsibility for the design and structural integrity of the stairway. The City Engineer will defer review of the proposed repairs and/or construction to the Building Official who works Gateway to the Olympics and Home of the Puget Sound Naval Shipyard Mr. Brett Hayfield June 26, 1985 Page 2 out of the Planning Department. Thank you for your patience and concern and please discuss the repair requirements with us when applying for the building permit. Donald L. He found some items that need to be repaired or replaced immediately. They are as follows. (1) Some of the steps need to be reinforced or replaced. Some are loose and have a tendency to rotate when stepped on. (2) A portion of the handrail on the top platform needs to be replaced or reinforced. (3) The stairway deflects excessively under load. This causes the stairway to "bounce" as traffic progresses up and down the steps. This excess deflection needs to be eliminated, possibly by adding a temporary support at midspan of the stairway. The stairway needs to be replaced in it's entirety as soon as possible. I recommend that you give the owner a two week time limit to replace the stairway. In the interim the owner should be directed to eliminate the deficiencies listed above. If in the event that the owner does not remedy the above deficiencies immediately or that the stairway is not replaced within two weeks the stairway should be closed to traffic. The Shoreline Management Substantial Development permit states that the new stairway design shall be approved by the City Engineer. The Engineering Department does not have any additional requirements for a stairway other than the Standard Uniform Building Code requirements. Therefore, the new design should be in accordance with the Uniform Building Code and reviewed and approved by the Building Department. AL AN KANE, P.E.
