SUMMARY: The City has had agreements with the Rocky Point Water District No. 12 (District) for
many years. The City owns all municipal water infrastructure within the District's service area
(mains, meters, hydrants, etc.,) provides billing and water quality compliance sampling services, and
is responsible to collect a surcharge to be paid to the District. The District is required to reimburse
the City for billing and monitoring services rendered (last payment received was March 2019) and is
responsible for capital improvements. The most recent agreement with the District has an expiration
date of June 30, 2015. Repeated attempts to communicate with the District both prior to and since
the expiration date have been unsuccessful. On August 31, 2020 the Washington State Department
of Health (DOH) transferred the District's service area to the City. While the District is effectively
non-existent, it remains a legal entity until formally dissolved by Kitsap County. This is problematic
for customers requesting new water connections since the terms of the expired contract require
coordination with the District which is not possible at this time. The proposed Resolution allows the
City to sell new water service connections within the former District service area, until the District is
formally dissolved.
