The City shall have access to any of the Vendor's records needed for evaluating the protest. The City will evaluate all protests, provided the procedures in this section are followed. If the City determines that a protest is valid, the City will adjust payment for work or time by an equitable adjustment. No adjustment will be made for an invalid protest. B.Vendor's Duty to Complete Protested Work. In spite of any protest, the Vendor shall proceed promptly to provide the goods, materials and services required by the City under this Agreement. C.Vendor's Acceptance of Changes. The Vendor accepts all requirements of a change order by: (1) endorsing it, (2) writing a separate acceptance, or (3) not protesting in the way this section provides. A change order that is accepted by Vendor as provided in this section shall constitute full payment and final settlement of all claims for contract time and for direct, indirect and consequential costs, including costs of delays related to any work, either covered or affected by the change. D.Failure to Protest Constitutes Waiver. By not protesting as this section provides, the Vendor also waives any additional entitlement and accepts from the City any written or oral order (including directions, instructions, interpretations, and determination). The Vendor shall begin to correct any defects within seven (7) calendar days of its receipt of notice from the City of the defect. If the Vendor does not accomplish the corrections within a reasonable time, the City may complete the corrections and the Vendor shall pay all costs incurred by the City in order to accomplish the correction. IX. INDEMNIFICATION. Vendor shall defend, indemnify and hold the City, its officers, officials, employees, agents and volunteers harmless from any and all claims, injuries, damages, losses or suits, including all legal costs and attorney fees, arising out of or in connection with the performance of this Agreement. Vendor’s obligation to indemnify shall not extend to that portion of damages caused by the City’s sole negligence. The City's inspection or acceptance of any of Vendor's work when completed shall not be grounds to avoid any of these covenants of indemnification. Should a court of competent jurisdiction determine that this Agreement is subject to RCW 4.24.115, then, in the event of liability for damages arising out of bodily injury to persons or damages to property caused by or resulting from the concurrent negligence of the Vendor and the City, its officers, officials, employees, agents and volunteers, the Vendor's liability hereunder shall be only to the extent of the Vendor's negligence. IT IS FURTHER SPECIFICALLY AND EXPRESSLY UNDERSTOOD THAT THIS INDEMNIFICATION CONSTITUTES THE VENDOR'S WAIVER OF IMMUNITY UNDER INDUSTRIAL INSURANCE, TITLE 51 RCW, SOLELY FOR THE PURPOSES OF THIS INDEMNIFICATION. THE PARTIES ACKNOWLEDGE THAT THEY HAVE MUTUALLY NEGOTIATED THIS WAIVER. The provisions of this section shall survive the expiration or termination of this Agreement. X. INSURANCE. Parkcenter Blvd. Suite 100, Boise, ID 83706-6659 (208) 387-7000 1 Technical Memorandum Date: Tuesday, February 11, 2020 Project: City of Bremerton Wastewater Salinity Impact Study To: William Davis and Ned Lever, City of Bremerton From: Michael Murray and Eric Bergstrom, HDR Subject: Land Application Site - Recommendations and Instructions for Sampling HDR visited the City of Bremerton biosolids land application site on December 20, 2019. In attendance for the site visit were Mike Murray and Bryce Figdore for HDR, accompanied by the City of Bremerton’s Dave Denis and Ned Lever. This technical memorandum presents HDR’s recommendations and instructions for soil sampling and biosolids sampling for salts that was discussed during the site visit. Background The City of Bremerton operates a Class B biosolids forest land application site comprised of two areas with total of approximately 520 acres. The City land applies its biosolids using a sludge slinger that distributes the solids up to a distance of 170 feet. Beginning in 2014, the City became concerned of potential salt damage to trees and canopy understory from the application of biosolids. The City’s concern is related to a measurable increase in influent wastewater electrical conductivity (a measure of inorganic salt concentrations in water) that was observed in wastewater sampling and the potential carryover of this salt into the biosolids. Sampling After reviewing the forested land application area and discussing potential salinity concerns with staff, HDR provides the following recommendations: Soil Sampling: •Soil samples should be collected during the summer months and preferably during a hot dry weather trend. The goal is collect samples after biosolids application (preferably 2 to 3 days after application) and during a time where rainfall is minimal. Soil samples may be collected during wet weather, though it is not preferred. If soil sampling during wet weather is required, then sampling should be completed within 48 hours following biosolids application. •Collect a composite soil sample for each of the designated sites in Areas 1 and 2. For each area, collect 8 subsamples at 0- to 1-foot depth using a shovel, trowel, or soil auger or probe, place samples into a clean bucket or stainless steel bowl, lightly mix (blend) the subsample soils by hand, and then place the sample (or portion of it) Appendix B (4 pages) DocuSign Envelope ID: 3221EA88-6A18-4E88-8AD5-B7161595FACB hdrinc.com River Quarry at Parkcenter, 412 E. Parkcenter Blvd. Suite 100, Boise, ID 83706-6659 (208) 387-7000 2 into a 1-gallon zip-lock baggie. Sample locations should be representative of the designated area, but within the 170 foot biosolids sling area. • Based on the Biosolids Program Site Map there are 14 application areas within Site 1 and 7 areas within Site 2, resulting in the collection of 21 soil samples. A map is attached illustrating Site 1 and Site 2, with a recommended sampling approach provided. As described in the map, actual sampling locations are determined in the field (general approach and sampling areas are provided in the maps). For each field, it is recommended that the sampler start at the road access (where the truck applied biosolids), and select 8 locations within 170 feet from the road (representing areas where biosolids are applied). Locations should be based on best judgement but ideally sample locations are spatially representative of the field within 170 feet of the road. The goal is to understand typical salt levels in a field that received direct biosolids application. • Place soil samples into a cooler, add chilled ice packs, and ship to an agricultural soil testing laboratory. If the City does not have a preferred laboratory, HDR recommends Kuo Testing Labs of Othello, WA. HDR recommends that the laboratory perform the following test on the samples: Test W2, along with soluble salts (note W2 is a test for west of the Cascades and includes nutrients, and may provide information on any nutrient imbalances). Biosolids Sampling: HDR recommends that the City measure soluble salts in the biosolids by executing the following: • Collect three separate biosolids samples that are representative of biosolids going to the land application site. It is recommended that samples be collected from the storage bunker at the site, one sample per week for one year. For each biosolids sample, collect 8 subsamples from within the stockpile (randomly select 8 locations and sample within the pile avoiding the outer 6 inches), placing the subsamples into a bucket, lightly mix, and then transfer a portion of the mixed sample to a 500-mL glass sample jar. Measure soluble salts following the attached method (see last page of this technical memorandum). Results are expressed in mmhos/cm. Interpretation Once sampling results are available from the soil and biosolids testing, HDR will review the data and provide interpretation. Parkcenter Blvd. Suite 100, Boise, ID 83706-6659 (208) 387-7000 3 Soluble Salts in Biosolids Place 200 grams of biosolids (wet weight) into a 500 mL glass or plastic beaker. Slowly add deionized water and stir by hand using spoon or spatula. Continue to add water until a paste is created. At saturation, the biosolids paste: • Does not have free standing water on the surface of the paste. • Paste slides freely and cleanly off a spatula • Paste will flow slightly when the container is tipped to a 45 degree angle from horizontal. Allow the paste to sit for 1 hour. Add water if necessary to get paste characteristics described above. Next, filter the extract to obtain the filtrate (liquid). One approach to filtering is to transfer saturation paste to buchner funnel filter paper (or equivalent) and spread evenly over surface. Apply vacuum and collect filtrate in test tube. Discontinue vacuum when cracks appear in the paste. Measure the electrical conductivity of the filtrate following SM2510 for conductivity measurement procedures (most labs routinely run electrical conductivity). This is the same as measuring water samples for conductivity. DocuSign Envelope ID: 3221EA88-6A18-4E88-8AD5-B7161595FACB Sampling Approach for each Field •Access each field from road that is used for biosolids application (slinger truck). •Divide the road along the field into 4 equal segments (approximate, this does not need to be exact). •Within each segment, collect 2 subsamples: •The 1st sample approximately 50 feet from the road (sample is 0 to 1 foot depth). Place sample in bucket (or bowl). •The 2nd sample approximately 100 feet from the road (sample is 0 to 1 foot depth). Place sample in bucket. •Samples can be in approximate straight line at 50 and 100 feet from the road. Use you best judgement on locations we are looking for representative soil locations that have high chance of receiving biosolids from the slinger. •Repeat this in the remaining 3 segments (place samples in same bucket as other segments). Thus, bucket has 8 subsamples. •Mix soils in the bucket, and then take enough sample from bucket to fill about ¾ of 1-gallon zip-lock baggie. •Repeat for other fields.
