Agreement between the City of Bremerton
and the City of Port Orchard

SUMMARY: WAC 246-293-250 requires public water purveyors who share a common service area
boundary to enter into service area agreements that delineate the service area boundaries and
establish a process by which service area boundaries may be modified. The City has agreements
with all other adjacent public water purveyors except Port Orchard. This agreement will fulfill the
requirement.
The Kitsap County Coordinated Water System Plan provides a service area agreement template
which was used as the basis for this agreement. Legal staff from both the City of Bremerton and the
City of Port Orchard have reviewed and approved the agreement as to form.
This agreement only records existing service area boundaries and a process by which boundaries
may be modified; it does not modify existing boundaries nor establish water utility policy.

RECOMMENDED MOTION:
Move to approve the Service Area Agreement between the City of Bremerton and the City of Port
Orchard; and authorize the Mayor to finalize and execute the agreement with substantially the same
terms and conditions as presented.
