License Agreement with American Tower for COUNCIL MEETING Date: December 18, 2019

SUMMARY: This License agreement with American Tower is for the placement of City owned
equipment on the existing north tower on parcel 292401-2-002-2008 located on Water Utility property.
The equipment includes the Sensus Base Station M400 purchased via the Ferguson Sensus
Purchase and Installation agreement. American Tower and the City of Bremerton have a current
agreement for the land lease which is set to expire on June 20, 2020 and is currently in negotiation
for the terms of this long-term land lease renewal. The current land lease gives the City of Bremerton
access to install our equipment on this tower per section 10.b. The License Agreement is at no cost
to the City with an initial term of 5-years with three 5-year renewal terms.

FISCAL IMPACTS (Include Budgeted Amount): $0 installation for these items are included in the
2020 budget and are expensed under the Ferguson Sensus Base Station Equipment purchase and
installation agreement.

RECOMMENDED MOTION:
Move that the City enter into a license agreement for the communication site on parcel 292401-2-
002-2008 with American Tower; and authorize the Mayor to finalize and execute the agreement with
substantially the same terms and conditions as presented.
