SUMMARY: The proposed ordinance grants Puget Sound Energy, Inc. the right, privilege, authority
and franchise to install and maintain their facilities within and upon the City's rights-of-way for
purposes of transmission, distribution, and sale of energy for power, heat, light, and any other
purpose for which energy can be used; and to charge and collect tolls, rates, and compensation for
such energy and such uses. The terms updated in this Franchise Agreement are section 5, the
Indemnification and Insurance requirements, and section 9, Term of the agreement.
ATTACHMENTS: 1) Ordinance No. 5385 (Corrected); and 2) Franchise Agreement
FISCAL IMPACTS (Include Budgeted Amount): No change; per RCW 35.21.860 no city or town
may impose a franchise fee or any other fee or charge...upon the light and power...businesses, as
defined in RCW 82.16.010.
