THIS INSTRUMENT made this,2,61 of 3-40^.4,,.'7 , 2019, by and
between Oyster Bay Holdings LLC (hereinafter "Grantor") and City of Bremerton
(hereinafter"Grantee").
WITNESSETH that Grantor for and in consideration of mutual benefits derived
and/or other valuable consideration, receipt of which is hereby acknowledged by Grantor,
do by these presents grant, bargain, sell, convey, and confirm forever unto Grantee, its
successors and/or assigns, an easement for sewer utilities, with necessary appurtenances,
over, through, across and upon the following described property situated in Kitsap County,
Washington, more particularly described as follows:

Grantee shall have the right,without prior institution of suit or proceeding at law, at
times as may be necessary, to enter upon the above-referenced property with the necessary
equipment for the purposes of altering, installing, operating, maintaining, extending,
constructing, repairing, and reconstructing the utility/utilities, or making connections to
that system, without incurring any legal obligation or liability; provided, however, that the
private improvements existing within this easement area shall not be disturbed or
destroyed, or in the event they are disturbed or destroyed, they will be replaced in as good
a condition as they were immediately before the properties were entered upon by the
Grantee.
Grantor shall retain the right to use the surface of this easement, so long as that use
is not inconsistent with and does not interfere with the rights and uses granted to Grantee
in this document. Under no circumstances shall Grantor place any cement, concrete,
structure,trees, large shrubs or any other objects on the property described in this easement
in a manner that would interfere with Grantee's use of the easement.
This easement shall be a covenant running with the land, and shall bind Grantor's
successors and assigns and all future owners of the real property affected by this easement.

An easement across a portion of the following described property,
All of blocks 13,20,21,24,25 and 28, Bremerton Heights,according to the Plat recorded in
volume 3 of Plats,page 41,records of Kitsap County, Washington,lying southwesterly and
westerly of the westerly right-of-way of SR3;
Except that portion of above property taken for State Highway.
And together with vacated Streets D,E,F,G,H and that portion of Bayview Avenue between C
Street and E Street by city of Bremerton Ordinance No. 4621 and recorded under Auditor's file#
3065426;records of Kitsap County,Washington. Together with that portion of vacated C Street as
attached by Operation of Law per Ordinance#4725,recorded under Auditor's file#200012040157
records of Kitsap County, Washington. Subject to and easement over that portion of vacated C
Street as described under Auditor's file#200012040157.
A sewer easement area inside the follow described lines;
Beginning at Point"A",also being the SE corner of the above described property,
Thence a line continuing west along the south property line a distance of 17 feet,to a Point"B".
Thence a line continuing northerly to a Point"C",which is 160 feet north along the east property
line,from Point"A".
Thence a line continuing 160 feet southerly along the east property line to close at Point"A".
