SUMMARY: The Agreement with Waste Management passed by the City Council at its October 17,
2018 meeting included the following language in Section 9.1 "The Administrative Fee shall be used
by the City for costs the City has identified from solid waste services, including costs for contract
administration, solid waste planning and management, and street preservation and maintenance."
This language was added to Section 9.1 in error, and staff believes it should not be included in a 10 -
year contract with a service provider since expenditures from the General Fund are an internal policy
matter. Currently and historically the administrative fee is directed to the General Fund, and not
associated with a specific activity. To correct this error, staff propose to strike the last paragraph in
Section 9.1 in the final version of the agreement to be executed.
ATTACHMENTS: Section 9.1 of the new Agreement with Waste Management
FISCAL IMPACTS (Include Budgeted Amount): The Administrative Fee collected from Waste
Management may be directed to any general government service as identified in the budget or other
process.
