SUMMARY: The adjacent property owner has petitioned the City to have a portion of the alley
located west of Wheaton Way and south of East 13th Street vacated to facilitate their planned
townhome development. The alley portion fronts 3 properties; 1147 Wheaton Way (the applicant),
1145 Wheaton Way and 1903 East 13th Street. The owner of 1903 East 13th Street has signed the
petition to support the vacation, the owner of 1145 Wheaton Way has not endorsed the vacation.
The two property owners supporting the vacation comprise 78% of the vacation frontage. BMC
11.20.070 states "if the petition is signed by the owners of more than two-thirds of the property on a
front footage basis...the council, shall by resolution, fix a time when the petition will be heard."
Easements will be retained for access, private utilities and potential City utilities.
