SUBJECT: Ordinance No. 5346 to create
Chapter 6.12 of the Bremerton Municipal
Code, entitled "Unfit Dwellings, Buildings,
Structures, and Premises"; and to amend
BMC Sections 2.62.045 and 1.04.120

SUMMARY: Mayor Wheeler is moving forward with implementation of a proactive code enforcement
program and in support of that initiative is seeking to adopt new provisions into the Bremerton
Municipal Code (BMC) to support the program. The City Council received an overview of the
program and the proposed BMC changes at the study session on March 28th and was supportive of
the proposed new program and bringing forward the amendments to the BMC.
The proposed new Chapter in the BMC implements Chapter 35.80 of the Revised Code of
Washington (RCW), which allows the City to intervene in order to correct, repair, or remove
structures that are unfit for occupancy due to dilapidation, disrepair, structural defects, etc.

FISCAL IMPACTS (Include Budgeted Amount): The Abatement Fund has approximately
$275,000 in funding available from Fines and Penalties for implementation of the provisions of this
new code. Staff will monitor the balance of the Abatement Fund and provide periodic updates as
necessary to the Council.
