SUMMARY: The scope of WSDOT's overlay of State Route 303 (Warren Avenue and Wheaton
Way) includes a grind and overlay of the travel lanes only, without any surface treatment to the
center turn lane. In order to have a more attractive and uniform looking finished product, the City
requested WSDOT prepare an agreement to install an asphalt emulsion seal coat (fog seal) over the
center turn lane. The cost of this work is estimated at $99,042.40; however the Agreement includes
a provision to allow WSDOT to exceed this value by 25% (up to a total of $123,803.00) without
seeking approval from the City. The requested action is approval of an Amendment to the Local
Agency Participating Agreement with WSDOT.

RECOMMENDED MOTION:
Move to approve the Local Agency Participating Agreement with WSDOT to apply a fog seal. to the
center turn lane of State Route 303 within the City Limits, and authorize the Mayor to finalize and
execute the agreement with substantially the same terms and conditions as presented.
