Facade Maintenance Agreement and Covenant
to the City of Bremerton, WA
This agreement and covenant for facade mai tenance is made this '2,2'day of Mia

and the City of Bremerton, Washington.
WHEREAS, the Property Owner, ,�7 , �(kJ� i owns the property located at [address]

WHEREAS, the City of Bremerton has made available funds for fa9ade grants;
WHEREAS, the Property Owner receiving grant funds will, after completion of the project,
assume the total cost of the continued maintenance, repair and administration of the property in a
manner satisfactory to the City of Bremerton;
WHEREAS, a grant in the amount of $196,629 has been awarded to Property Owner Sound
West Holdings LLC for the property located at 252 40' Street, as reimbursement for the building
of a fagade; and
WHEREAS, if the Property Owner should deem it necessary to make changes to the fagade
during the maintenance period, Property Owner will submit a written notification to the City of
Bremerton.
NOW THEREFORE, the Property Owner agrees and covenants as follows, as part of the
consideration for receipt of said grant funding:
For a period of five years from the date this agreement is signed by the Property Owner, there
shall run with the land a covenant, in favor of and enforceable by the City of Bremerton,
requiring the Property Owner and any successors in interest at their own expense to repair,
maintain and administer the features, materials, appearance, workmanship, and environment of
the premises in the state of repair and condition as at the time of completion of the grant -assisted
work. Nothing in this agreement shall prohibit the Property Owner from seeking financial
assistance .from any source available to him.
The Property Owner shall submit written notification to the City of Bremerton prior to making
any changes to the faeade during the five-year covenant period.
In the event of a violation of any covenant or restriction herein, the City of Bremerton shall have
available all legal and equitable remedies to enforce the Property Owner's obligations hereunder.
