CITY COUNCIL SPECIAL MEETING MINUTES
March 29, 2017
A Special Meeting of the City Council of the City of Bremerton was called to order Wednesday, March
29, 2017, at 5:00 PM in Council Conference Room 603 of the NORM DICKS GOVERNMENT CENTER,
345 6th Street, Bremerton, Washington, with Council President Eric Younger presiding. Council
Members present were Richard Huddy, Dino Davis, Greg Wheeler, Jerry McDonald, Leslie Daugs,
and Pat Sullivan. Also present were City Attorney Roger Lubovich; Assistant City Attorney Kylie
Purves; City Clerk Shannon Corin; and Legislative Assistant Lori Smith.
A COUNCIL BRIEFING was held to discuss General Council Business at 5:00 PM in the Council
Conference Room. At 5:30 PM the meeting moved to the Meeting Chambers.
The Pledge of Allegiance was led by Council Member Pat Sullivan followed by the invocation
provided by Reverend Ron Anderson of Manette Community Church.
INTRODUCTION
President Younger summarized background information to briefly explain why this meeting was
scheduled, a process that began with a request from the Kitsap Immigrant Assistance Center.
He read a statement from the Municipal Research & Services Center (MRSC) on Sanctuary Cities;
highlighted the Bremerton Police Department Policy No. 428 on "Immigration"; referred to history
from the last 18 years to show an established pattern by Council to use resolutions to show
support of an issue by a super majority; announced a number of citizen correspondence has been
received and read by Council; and explained that although public comment is usually not taken at
Study Session, the main purpose of the Special Meeting tonight was to receive public input.
President Younger highlighted Federal funding currently being received by the City; and then
referred to the Oath of Office taken by Council Members when sworn into Office, and even though
there was no specific resolution before the Council for a vote, he asked Legal if Council would be
in violation of their Oath if they supported a resolution that specifically used "Welcoming City" or
"Sanctuary City". Kyle Purves, Assistant City Attorney stated that the Oath generally does not
create a positive duty on the part of the local official to carry out federal laws, and that this
conclusion is supported by the US Supreme Court Case decision in 1997 "Printz v. United States:
Tenth Amendment Limitations on Federal Access to the Mechanisms of State Government'.
