DEPARTMENT OF COMMUNITY DEVELOPHIENT
MEMORANDUM
To: City Council
From: Andrea L.Spencer,Director
Date: October 12,2016
Subject: Potential Annexation Progress and Process—Clogston
This memo is to inform City Council on a potential annexation within the East Bremerton Urban Growth
Area.
The City of Bremerton recently received a request for Water&Sewer Availability Letter for 4306
Clogston Avenue NE (Tax Parcel 3962-000-024-0002)to develop about a 20 lot subdivision. This property
is within the Kitsap County jurisdiction but is within the City of Bremerton's East Bremerton Urban
Growth Area (UGA). A City of Bremerton Water&Sewer Availability Letter is required to demonstrate to
Kitsap County that the subdivision proposal has sufficient access to water and sewer.
The Bremerton Municipal Code 15.03.040 was recently amended and it requires that properties located
outside the City limits annex into the City before wastewater utility services are to be provided. The
Clogstori property is within the City's UGA and is contiguous to the City limits, and Staff has determined
that the annexation is feasible. Thus, the City is in the process of preparing this area for annexation and
wanted to notify the Council on the pending action.
PROCE:SS
There are several methods of annexation under State law. Staff will be potentially using the 60% Petition
Method as regulated by RCW 35.13.125 for the Clogston property. Here are the summary of the steps of
the annexation process:
1. Initiation Request: An annexation petition is initiated with at least 10%of the assessed
value of the property or 10%of the residents of the property to be annexed.
2. Council Resolution: Within 60 days of the initial request, the petitioners and the City
Council meet to set a resolution for the proposal. The following are the questions to be
addressed in the meeting:
■ Whether the city will accept, reject,or geographically modify the proposed
annexation;
■ Whether it will require the simultaneous adoption of a proposed zoning
regulation; and
■ Whether it will require the assumption of all or any portion of existing city
indebtedness by the area to be annexed.
3. Petition of 60%: With the boundary set by City Council, the next step is to get 60%of the
Petitioners to Sign for support of the annexation. Outside Utility Agreements also count
as signatures on the petition. Please note that 60%is of the assessed value of the
property for which annexation is petitioned. '
■ Determination of Sufficiency: Once we get this, the City sends the 60%
signatures to the Kitsap County Assessors and they promptly verify the accuracy.
4. Boundarv Review Board (BRB):All annexations get reviewed by Kitsap County's BRB.The
BRB sends it around to all agencies and Kitsap County Departments. If no one "request
I
for review" within 45-days,then it has been approved by the BRB. If an agency/Kitsap
; County or if someone being annexed wants to further review, then it may be expanded
; to a 180-day review.
5. Council's Hearin: Hearing on Petition through City Council. If all the items above are
' satisfied, then we go in front of City Council again to approve the annexation. If that is
approved then this property is now within the City.
 PROGRESS
Staff is preparing the information for this potential annexation including boundary identification, fiscal
! impacts to the City for this annexation area, and is getting ready for a public process. Staff will attempt
to annex as large of an area as possible through the utilization of the existing signed Outside Utility
; Agreements(OUAs). We are reviewing all OUAs within the area to ensure their validity.
' Department of Community Development Staff will be taking the lead on any annexations through the
City Council process, however Public Works and the Legal Oepartments are also contributing to progress
' of this proposal. City Council will see the next progress on any annexation through a Council packet.
