SUMMARY: Construction was recently completed on the 606 Apartments. The proposed
Memorandum of Understanding (MOU) outlines the responsibilities for maintenance and utility use
for the common areas used by both the City and 606 Apartments. The proposed Air Rights
Easement corrects legal descriptions and updates the easement previously granted to 606 Lorax,
LLC for use of certain air space for balconies and related structures.

Move to approve the Memorandum of Understanding and updated Air Rights Easement granted to
606 Lorax, LLC; and authorize the Mayor to finalize and execute the easements with substantially the
same terms and conditions as presented.
