Home My WebLink About3273 RESOLUTION NO. 3273 A RESOI.UTION of the City Council of the City of Bremerton, Washington, approving Phase 2 of the Bayside Final Plat(File No. BP16-00033). WHEREAS, On January 31, 2007 the Administrative Hearings Examiner granted Preliminary Plat approval after holding an open record public hearing to divide 56 acres into 294 housing units, and WHEREAS, Phase 1 Bayside Final Plat was recorded on June 10, 2013, and WHEREAS, Phase 2 of the Bayside Final Plat includes 1641ots with associated open space tracts, and Rights of Way, and WHEREAS, after preliminary plat approval, the applicant submitted and received approval for Site Development Permit Plans documenting the final infrastructure plans for the plat; and WHEREAS,the applicant has posted performance bonds for the public and private infrastructure required in the preliminary plat approval; and WHEREAS, the applicant has proposed three areas of construction with separate bonds to allow the construction and acceptance of the infrastructure to be phased within the division; and WHEREAS,the applicant has agreed to substantially complete all infrastructure within each construction area prior to issuance of any residential building permits within that area of the plat; and WHEREAS, all applicable conditions set forth in the Preliminary Plat approval have been met or bonded for and Final Plat approval is requested; WHEREAS, the City Engineer and DCD Director recommend approval of Phase 2 of the Bayside Final Plat,NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF BREMERTON, WASHINGTON, DOES HEREBY RESOLVE AS FOLLOWS: SECTION l. Phase 2 of Bayside Final Plat as represented by the schematic drawing in Exhibit A titled "Freestone at Bayside Division Two" is hereby approved, subject to the following conditions: 1. The stormwater maintenance agreement shall be executed with the City Public Works Department and recorded against the property prior to the recording of the final plat document; and 2. The lot corners, landscape and open space improvements contained in Phase 2 and bonded for with the Department of Community Development, shall be completed by the applicant and accepted by the City within the timelines established within the bonds unless an extension is granted by the Director of Community Development; and 3. The Public infrastructure and onsite mitigation requirements, constructed with Phase 2 and bonded for with the Department of Public Works, shall be completed by the applicant and accepted by the City the timelines established within the bonds unless an extension is granted at the discretion of the City Engineer; and 4. No building permit within Phase 2 will be issued for residential construction unless the infrastructure improvements within that construction area have been substantially completed and accepted by the City. Substantially complete shall generally include functional utilities and complete streets. At the discretion of the Community Development Director and City Engineer,the following types of items may not be required for substantial completion, but are required prior to bond release: a. Street lighting; applicant shall demonstrate that the required street lighting is on order, and agree to conditions on each building permit requested prior to installation of the lighting that document the installation of street lighting is required prior to occupancy. b. Minor punch list type items that do not affect occupancy of the residences. c. Installation of landscape materials. SECTION 2. The City Council President is hereby authorized to sign the Plat Document. SECTION 3. Severabilitv. If any one or more sections, subsections, or sentence of this Resolution are held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portion of this Resolution and the same shall remain in full force and effect. SECTION 4. Effective Date. This Resolution shall take effect and be in force immediately upon its passage.
