My records indicate your building permit application for your new
garage structure at 1718 Anderson is due to expire on 5/8/90.
Section 304(d) of the 1988 Uniform Building Code states
"Applications for which no permit is issued within 180 days
following the date of application shall expire by limitation... The
building official may extend the time for action by the applicant
for a period not exceed 180 days upon request by the applicant
showing that circumstances beyond the control of the applicant have
prevented action from being taken."

ADMINISTRATIVE VARIANCE
ADM VAR-10-89
SUMMARY
The applicant is requesting an administrative variance to allow
the construction of an accessory structure (garage) wi thin the
required 20-foot front yard setback.
FINDINGS
1. Applicant: David and Ina Wingo
2. Location of Variance: 1718 Anderson Street
3. Comprehensive Plan Map: Residential 15 to 30 dwelling units
per acre.
4. ZoninQ: Duplex Residential
5. The parcel as shown on assessor's plat map fronts on two
publicly dedicated rights-of-way, Anderson Street and Naval
Avenue. Because the Zoning Ordinance defines the front yard
as that portion of lot which has frontage along a right-of-
way, the lot has two required front yard setbacks.
6. A duplex structure is currently developed on the site and
surrounding properties. The si te has no other accessory
structures or carports. The adjacent Naval Avenue right-of-
way is undeveloped due to very steep slopes. Anderson Street
is the principle front yard for the Wingo residence and
adjacent properties.
7. A "personal vehicle storage garage" is an allowed accessory
use in this zoning district, provided it meets all the
development requirements that might apply it.
8. Two off-street parking spaces are required for a single-family
residence. There is no requirement for them to be covered
spaces or within a structure.

9. The applicant states the garage is needed for his trailer,
truck and car. Trucks and recreational vehicles are fairly
common, but probably not "customarily found in connection with
the principal use" and certainly not necessary for that use
to exist.
10. The site plan shows an area to the south of the dwelling in
which the proposed garage might fit without a variance. The
applicant does not explain why this area can't be used.
11. The shape of the lot did not create this situation. The
applicant's desire to place a larger than typical structure
on a portion of the lot that isn't large enough is the
problem. The "hardship" is self-imposed.
12. The applicant is not requesting a variance to allow a
structure that "is similar to that allowed on similar
properties in the same area or zone". A similar structure
would be a more typical one- or two-car garage approximately
half the size requested.
13. The amount of variance requested is approximately 16 feet
deeper than necessary for a smaller garage. It is well beyond
the minimum variance necessary for a garage at the proposed
location.
14. Criteria for Approval of Administrative Variances:
A. SubstantivelY Consistent with the Comprehensive Plan.
The proposed garage is a permitted accessory use in a
Single-family Residential neighborhood. The proposal is
substantively consistent with the Comprehensive Plan and
will not compromise its intent.
B. Not Detrimental to the Public: Construction of a garage
wi th limi ted intrusion in the required setback areas will
not be detrimental to the public welfare. A typical
garage having a depth of 24 feet could be constructed
with a minimal variance of about five feet, 15 feet from
the Naval Avenue right-of-way at the proposed location.
This would be the minimum variance needed to accommodate
a garage of the size commonly found in a residential
neighborhood and used to protect automobiles and small
trucks.
C. Special Circumstances: The shape of the lot and presence
of two rights-of-way create a special double setback
circumstance that may justify some degree of variance,
provided all other possibilities for the siting of the
proposed structure on other parts of the property have
been considered and there are no other feasible and
better locations.

D. Development Common to the Area: While garages are common
accessory structures found throughout several residential
neighborhoods in Bremerton, no other surrounding or
adjacent properties have similar structures. A variance
greater than that described in "B" above could be viewed
as granting a special exception for this applicant and
variances greater than the minimum amount necessary are,
in most instances, not approved.
E. Adjoininq Owners Approval: Adjoining property owners
have indicated their approval after notification and
review of the proposal. The application includes their
signatures of approval.
F. Conditions or Hardship Not Self-created: The ~onditions
that justify a variance of 19 feet at this location are
self-created.
CONCLUSIONS
1. The proposal is substantially consistent with the
Comprehensive Plan and will not be detrimental to the public.
2. The shape of the lot and presence of two rights-of-way creates
a special circumstance to justify some degree of variance.
3. A structure could be constructed that would maintain a 20-foot
setback from Anderson Street and still allow 24 feet of
building depth while maintaining a fifteen-foot setback from
the Naval Avenue right-of-way.
4. To vary the Anderson Street 20-foot setback is a self-created
hardship.
5. Adjoining properties enjoy a 20-foot setback from Anderson
Street. To vary this setback would grant a special privilege
for this applicant.
DECISION
Based on the Finding of Fact and Conclusions, as the Director of
Community Development, the duly appointed Administrative Variance
Official, hereby approves Administrative Variance application, File
#ADM VAR-I0-89, by David and Ina Wingo, 1718 Anderson Street
subject to the following conditions:
1. This variance is for the purpose of constructing a residential
garage on the subject property on the north side of the
existing dwelling.

2. This variance grants the applicant an intrusion into the Naval
Avenue setback, a distance of approximately five (5) feet in
order to construct a garage having a depth of twenty-four (24)
feet while maintaining the required twenty (20) foot setback
from Anderson Street.
3. This variance does not limit the width of the garage and does
not preclude the applicant from placing the garage at a
different location on the property without a variance.
4. Compliance with all other zoning provisions ~s required.
