A RESOLUTION of the City Council of the City of
Bremerton, Washington, adopting the 2016 Work Plan authorizing
street maintenance, repair and construction projects from
Transportation Benefit District funds.
WHEREAS, in Ordinance No. 5076, the City Council of the City of Bremerton
established the Bremerton Transportation Benefit District as authorized by RCW 35.21.225 and
subject to the provisions of RCW 36.73; and
WHEREAS, in Resolution No. 005, the Bremerton Transportation Benefit
District established an annual vehicle license fee in the amount of twenty-dollars ($20.00),
consistent with RCW 36.73.065, to be collected by the Washington Deparhnent of Licensing on
qualifying vehicles as set forth in RCW 82.80.140 and Chapters 36.73 and 46.16 RCW; and
WHEREAS, the funds collected from the vehicle license fee shall be used for
transportation improvements that preserve and maintain and improve the transportation
infrastructure of the City consistent with the requirements of Chapter 36.73 RCW. The funds
shall be used primarily for improvements to preserve and maintain the City's previous
investments in the transportation infrastructure, reduce the risk of transportation facility failure,
improve safety, continue the cost-effectiveness of the City's infrastructure investments, continue
the optimal performance of the transportation system, and make other related improvements as
authorized by Chapter 36.73 RCW; and
WHEREAS, on March 16, 2016, the City Council, following a public hearing,
passed Ordinance No. 5297 whereby the City of Bremerton assumed all of the rights,powers,
immunities, functions, and obligations of the Bremerton Transportation BenefitDistrict,
vesting the City with each and every right, power, immunity, function, and obligation
cunently granted to or possessed by the Bremerton Transportation Benefit District; and
WHEREAS, the City Council of the City of Bremerton desires to formalize and
adopt a project list for 2016 funding for Transportation Benefit District Projects;NOW
THEREFORE,
THE CITY COUNCIL OF THE CITY OF BREMERTON,WASHINGTON
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the Work Plan as set forth in Exhibit A attached hereto and
incorporated by reference is hereby approved and adopted.
SECTION 2. Severability. If any one or more sections, subsections, or sentences
of this Resolution are held to be unconstitutional or invalid, such decision shall not affect the
validity of the remaining portion of this Resolution and the same shall remain in full force and
effect.
SECTION 3. �fective Date. This Resolution shall take effect and be in force
immediately upon its passage.
