SUMMARY: The work covered by this Agreement is for City water and sewer pipe relocation to
accommodate a new WSDOT culvert installation. The City is providing the design drawings and
inspection services. WSDOT will incorporate the City's design into their construction contract and
will manage the construction. The City is obligated to pay for all constructions costs, WSDOT
inspection costs and related indirect costs. The specific work proposed under this agreement will be
perFormed during the State's construction of the SR 16 —Anderson Creek Tributary to Sinclair Inlet-
Removal of the Fish Barrier.
This amendment is due to a change in bid items and an increase in costs and revision of Section 3.1
is necessary.

FISCAL IMPACTS (Include Budgeted Amount): The original contract amount of$182,367.48
amended to new contract total $246,173.80. In addition, the amendment retains an allowance for a
25% increase for unforeseen conditions, and so total costs could be up to$307,717.25. The additional
expense can be absorbed within the major Utility work categories the funding is programmed within.

Move to approve Amendment#1 to the Utility Construction Agreement with WSDOT; and authorize the
Mayor to finalize and execute the agreement with substantially the same terms and conditions as
presented.
