DEPARTMENT OF COMMUNITY DEVELOPMENT
STAFF REPORT
SPECIAL USE PERMIT
Day Care Center and Pre-School
Application Date: September 20, 2002
File# PL02-0048
Date: October 10, 2002
SUMMARY:
1. Applicant: Vickie Foster
699 SW Little Tree Circle
Port Orchard, W A 98367
2, Location: 3446 Almira Drive
Viewcrest Village Apartments
3. Attachments: Application, Site Plan and Vicinity Map
4. Comprehensive Plan Designation: "MDR" Medium-Density Residential
5. Zoning Classification: "MF" Medium-Density Residential
(multi-unit)
6. Assessor Account #: 3992-001-001-0209
PROJECT DESCRIPTION:
The applicant has requested a Special Use Permit (administrative) to allow an existing community
center of an apartment-housing complex to contain a day care and pre-school for a maximum of
34 students. The existing structure will not be enlarged or modified from its present form to
accommodate for the use.
SURROUNDING ZONING AND LAND USE:
The subject site is surrounded by MF zoning in all directions. The site is apart of the Viewcrest
Villages Apartment complex that contains 300 apartment-housing units.
SITE CHARACTERISTICS:
The subject site contains approximately 22.2 acres of land and abuts Sylvan Way NE to the north
and Almira Drive NE to the east and west The site contains 300 apartment-housing units that
consist of the Viewcrest Village Apartments. The community building to the housing complex is
located on the east side of Almira Drive, and is the subject site of the requested permit The
topography of the site is generally level with open grass areas between housing complexes and
mature vegetation and trees are interspersed throughout the site,
SEPA DETERMINATION:
This project is categorically exemptfrom the SEPA requirements of WAC 197-11 as specified in
WAC 197-11-800 (6) (b) which exempts minor land use decisions,
CRITERIA FOR DECISION:
The Bremerton Municipal Code (hereinafter BMC) ("Figure 140", Appendix, Page 21 and 23,
Land Use Tables) stipulates that day care facilities (13 or more - all ages) and schools are
allowed in the MF zone, subject to approval of a Special Use Permit The Director of the
Department of Community Development has made a determination that this application warrants
an "administrative" application. Section 21.02,905 of the BMC addresses the Special Use Permit
aspect of this application.
SPECIAL USE PERMIT:
Section 21.02.905 reads as follows:
(d) Criteria for Approval: A Special Use Permit may be approved if all of the following
questions can be answered "YES."
(1) Is the proposal consistent with the City's Comprehensive Plan and either
designated SUP in the Zoning Ordinance, or is it being processes as an
"Unlisted Use."
(2) Will the proposal comply with all applicable development standards and
requirements, including the availability of all needed utilities and services?
(3) Will the proposal, along with any mitigation measures or other conditions of
approval, avoid significant adverse environmental consequences?
(4) Will the proposal be compatible with adjacent uses and the surrounding
neighborhood?
(5) Does the proposal comply with all other criteria or design guidelines that are
applicable to the specific use or type of development?
Consistency with Comprehensive Plan,
The Comprehensive Plan does not specifically address uses such as daycares and pre-schools.
It does, however, contain goals and policies that support the continued general development of
the City. The City of Bremerton, Comprehensive Plan: Element C - Planning Goals state:
Goal # 1 - Urban Growth:
d. Maximize the City's existing in-fill development potential to ensure the
most efficient use of existing utility infrastructure and development
Goal # 5 - Economic Development:
b. Accent the roles of small business, tourism, health services, education,
and social and cultural activities in diversifying Bremerton's economy.
The proposal meets the planning goals by utilizing existing in-fill development within the City and
providing and expanding services in the surrounding community and neighborhood.
There is some discussion of "institutional uses," including schools in the Land Use section on
page 24. The section acknowledges the fact that such facilities are directly related to the
population growth and are allowed on a case-by-case basis in areas where demand exists, The
File No. PL02-0048
proposal appears to be consistent with these provisions of the Comprehensive Plan and is also
permitted by zoning regulations that allow the proposed use as a "Special Use" within the zoning
district.
Compliance With Applicable Development Standards.
The proposed action will comply with all development standards as set forth in the BMC for the
MF zone, which includes a maximum building height of 40 feet, maximum lot coverage of 40 %,
and front, side and rear setbacks of 10, 5 and 20 feet. The proposed daycare center and school
would occur within an existing structure, therefore, no new construction or expansions will take
place and the proposal is exempt from meeting landscaping requirements, The proposal will
meet minimum parking stall requirements of 1 space per 5 children with 2 loading/unloading
spaces,
Environmental Consequences,
As indicated above, the community center building has been situated on the site for several
years, The proposed use of the site as a daycare and pre-school will not cause any structural
improvements to the building or site and the required parking spaces are already existing. Based
upon review of the application, it was determined that the proposal is exempt from the SEPA
process and no adverse environmental impacts would be caused as a result of the building being
used for the daycare and pre-school.
Compatibility With Adiacent Uses and Surroundinq Neiqhborhood.
As noted previously, the subject community center building is apart of a 30Q-unit apartment
complex that contains Section 8 housing and affordable housing. The proposed daycare and pre-
school would allow the residents of the complex and surrounding neighborhood an affordable
option for childcare. It is also noted that previously, the community center building was utilized as
a daycare for 14 years, however, has been vacant for the last 2 years.
Based upon a review of the site and by the fact that no adverse comments have been received
regarding the proposed use of the site, it is determined that the proposal is compatible with
adjacent uses and the surrounding neighborhood.
Compliance With Desiqn Criteria,
The existing community center that would house the proposed daycare and pre-school is an
established structure with no new construction or expansions planned. The structure meets the
basic development standards for the MF zoning district and would provide adequate parking for
the daycare and school in conjunction with section 21.02,590 and Figure 670(b) Appendix, page
40 of the BMC.
COMMENTS:
The proposal was transmitted to the appropriate City departments for review and comment. The
following comments were submitted:
