ACCESS EASEMENT

THIS INSTRUMENT made this � ,
between Maria Cunanan DDS PS (hereinafter "Grantor" and the CITY OF
BREIVIERTON, a Washington municipal corporation of Kitsap County, State of
Washington(hereinafter"Grantee").
WHEREAS the Grantee seeks ingress and egress over, through, and across the
below described real property; and
THEREFORE Grantor, for and in consideration of mutual benefits derived and/or
other valuable consideration, receipt which is hereby acknowledged Grantor, conveys to
the Grantee and its successors and assigns, the perpetual right, permit, license and
easement for the purpose of ingress and egress over, through, across and upon the
following described real property parcel(s), situated in Kitsap County, Washington.

Grantee shall have the right, without prior institution of suit or proceeding at law, at
times as may be necessary, to enter upon the above-referenced property, without incurring
any legal obligation or liability; provided, however, that the private improvements existing
within this easement area and the immediately adjacent incidental areas shall not be
disturbed or destroyed, or in the event they are disturbed or destroyed, they will be
replaced in as good a condition as they were immediately before the properties were
entered upon by the Grantee. Grantee shall not enter the property during Grantor's
business hours except (1) in case of emergency, (2) for inspections where heavy equipment
is not used, or (3) as otherwise authorized by Grantor. Grantee shall not impede access of
Grantor's business customers to Grantor's building. Grantee shall give Grantor notice
twenty four(24) hours prior to entering the property, except in case of emergency. Grantor
shall not be required to close its business upon Grantee entering the property.
Grantor shall retain the right to use the surface of this easement, including the
immediately adjacent incidental areas, so long as that use is not inconsistent with and does
not interfere with the rights and uses granted to Grantee in this document. Under no
circumstances shall Grantor place any cement, concrete, structure, trees, large shrubs or
any other objects on the property described in this easement or the immediately adjacent
incidental areas in a manner that would interfere with Grantee's use of the easement.
This easement shall be a covenant running with the land, and shall bind Grantor's
• successors and assigns and all future owners of the real property affected by this easement.

That portion of lots 29 and 30, block 29, United States Navy Yard Addition to Bremerton, according to plat
recorded in volume 3 of plats, page 63, records of Kitsap County, Washington, described as follows: Beginning
at the intersection of the most northerly line of lot 29, with the southwesterly line of the right of way of Wheaton
Way (Highway 21-B) , as said right of way was established on April 5, 1961; thence southeasterly along said
southwesterly right of way line a distance of 60 feet to the southeast corner of lot 30; thence southwesterly ,
