However, the full promise of the ADA will only be reached if we remain committed to continue our efforts to fully implement the ADA; and WHEREAS, on the 25th anniversary of the Americans with Disabilities Act the City of Bremerton celebrates and recognizes the progress that has been made by reaffirming the principles of equality and inclusion and recommitting our efforts to reach full ADA compliance; NOW THEREFORE, I, Patty Lent, Mayor of the City of Bremerton, do hereby proclaim July 26h, 2015 as the 25th Anniversary of the Americans with Disabilities Act and reaffirm to continue to work toward full ADA compliance. My name is Vivian Henderson and [ live near Long Lake in South Kitsap. [didn't come here today to weigh in on Bremerton's squabble with KRCC but I think it offers a"teaching"moment. I agree with one citizen who responded on the Sun's blog"It is good to see Bremerton flex its muscle". Go Bremerton ..... I'm not against a team of local leaders forming a coalition to mutually solve problems and/or disputes between our local Kitsap County jurisdictions. Perhaps KRCC is not the best vehicle for that. This is a good time to bring to your attention some issues that have bothered me for.a long time—and should bother every citizen in this county—especially our local elected oPficials. My reason for being here is to discuss Kitsap County and its cities participation in Puget Sound Regional Council (PSRC). This is an issue that rises above property rights or liberal or conservative, or Democrat or Republican. This is an issue of whether our citizens want to continue to be governed by those we elect here locally or do we turn our autonomy over to a regional body like Puget Sound Regional Council? A regional planning organization that develops poiicy and makes decisions about transportation planning, economic development and growth management in four counties; King, Pierce, Snohomish and Kitsap. They operate out of the Sth floor of a building on Western Ave. in Seattle with 66 employees and a FY2014-2015 budget of$31,258.000-taxpayers' money. What do we have in common with those [-5 corridor counties? PSRC asserts they are not a"regulatory"agency. They only develop policy and do not have the power or authority to regulate. But what they don't tell you is that they control billions of$$$'s in grant money— taxpayers' money. They've got a pretty big hammer. I am very concerned that our local elected officials through their compliance with PSRC policies are ceding their authority as a local government and in so doing are risking my clout and the power of my vote and that of all voters in Kitsap County. Have you ever voted for Dave Somers?Only if you have lived in Snohomish County. Mr. Somers is Snohomish County's representative on PSRC Growth Management Board... He has more influence on you than anyone you vote for in Kitsap County. So who cares who you vote for?- Who cares ifyou even vote? Several years ago I attended a KRCC meeting where a high ranking PSRC ocial publicly promised local elected officials that PSRC would resolve issues that are difFicult to resolve at the individual jurisdiction level". Translated from "political correctness"speak that means if a local elected ofticial casts a vote that is unpopular with the electorate they can tell the voters that the"PSRC made us do it"or"It's a condition of PSRC grant". [doubt that any of Kitsap County's representatives to PSRC have taken the time to study Vision 2040. If they really knew what was in it why would they be so willing to give up control of our local government? Why would they give up control of our local government to an organization in which Kitsap County has 3%of the vote and King County has 52%? Why would they willingly take your vote and clout as a taxpayer and make it powerless on issues dictated by PSRC? • - • . O' Help us man our Tou rist Gazeb+. . . City C/erk Shannon Corin announced that during the Council Briefing, Item 8A was added to the Agenda under General Business... GENERAL BUSINESS 8A—WASHINGTON DEPARTMENT OF NATURAL RESOURCES (DNR) EASEMENT AGREEMENT FOR THE WASHINGTON AVENUE PROJECT: Chal Martin, Public Works & Utilities Director, explained that the last permit needed to access the beach for the Washington Avenue project is the DNR easement agreement which outlines the terms and conditions the City must comply with in order to decommission the sewer lines and leave them in place within the tidal zone. Over the past several years, DNR has changed its policy toward these easements, providing agreements that are significantly more detailed and also more expensive. In addition, DNR has set a policy goal of removing, not leaving in place, decommissioned sewer lines. This document was finalized at 3:00 p.m. today and is, considering all of the elements of the current situation, supported by staff. Council approval of this agreement is required in order to maintain the Washington Avenue project schedule. There were no questions or comments from the public... 06:03:37 Motion was made by Davis and seconded by Younger; Questions were asked by Davis, Daugs, Runyon, McDona/d, Younger, and Wheeler, with responses provided by Mr. Martin, City Engineer Tom Knuckev, Engineering Manager Ned Lever, and Mr. Lubovich... Council Members collectively expressed their concerns that the Department of Natural Resources (DNR) was forcing the City to either remove the decommissioned pipe, or purchase an easement each year until the pipe was removed, under the threat of trespassing if the City does not comp/y... They summarized that this was essentially creating a dis-incentive for the City to abandon sewers by penalizing the City decommissioning the existing sewer on the beach. They further indicated that DNR was appeared to be standing alone in their direction to remove the sewer from the beach since the Suquamish Tribe, and the Department of Fish & Wildlife agreed that is more negative impact to the environment and marine life to remove the pipe rather than leave it in place... 06:40:08 M/S/C (Davis/Younger) Move to approve DNR Easement Agreement#51-092390; and authorize the Mayor to finalize and execute the agreement with substantially the same terms and conditions as presented. Grea Wheeler announced that volunteers are welcome to participate in the monthly Friends of Kiwanis Park Work Party to be held next Saturday, on June 27 from 9:00 to 11:00 AM. President Wheeler reopened Public Recognition.., PUBLIC RECOGNITION Paul Whitehead, Kenneth Gordon, and Paul Wriqht established that they were residents in a home owned by John T. Hoffman located at 827 6th Street, and earlier today they all received notices by the City to vacate the building in response to an order by the Bremerton Hearing Examiner for Mr. Hoffman to "remove fire hazards" and all tenants by June 30. Their concern was that they had nowhere else to go and that they were working hard to provide the necessary repairs and improvements to the structure to avoid being unexpectedly evicted but needed more time to take care of the code violations. Sherill Rose explained that she has worked with the homeless in Bremerton since 2011. She believes that the home in question owned by Mr. Hoffman is over 100-years old and instead of being condemned, should be repaired and considered for Historic Preservation. John T. Hoffman felt that the Fire Marshall was discriminating against him and the residents because they're poor; and if the home had heat and a working fire alarm, then there was no valid reason to condemn the building and evict the current residents who have no other place to live. President Wheeler thanked everyone for bringing these concerns to their attention; and that he would work with them to provide a list of resources, including assistance with relocation. COUNCIL ACTION: ❑ Approve ❑ Deny ❑ Table ❑ Continue ❑ No Action Form Updated 01/07/15 COUNCIL SUMMARY 2015 Water Resources System Improvements Project Overview Three projects were identified in the Water System Plan and included in the Water CIP. These projects were: 1. McKenna Falls Intake Improvements, which includes the following: • Modifications to the concrete channel to improve hydraulics and maintenance • Replacement of the traveling screen equipment • Installation of a main stem bypass system • Evaluation of the West Branch Intake 2. Hardening of the Casad Dam Overflow 3. Anderson Creek Pump Station 2 Sodium Hypochlorite Building. The three projects will be designed by a single consultant under the contract 2015 Water Resources System Improvements. Contract Summar The Engineering staff prepared and sent out Request for Proposals(RFPs)to four consulting firms. Two responses were returned and the City selected Murray,Smith, and Associates (MSA). For Items 1 and 3, MSA will perform pre-design,detailed design, and construction management support. Item 2 was originally scoped as a stabilization project twenty years ago,but the programmed budget is not enough to complete both the design and construction. Water Resources staff reevaluated the need for the project and recommend completing a study of the rock face in lieu of constructing the improvements. The study will be completed by subconsultant Shannon&Wilson who prepared the original evaluation. A scope and cost for the work by MSA was negotiated in the amount of$419,904. Construction of Items 1 and 3 is scheduled for 2016. Fiscal Summarv The work is fully funded in the 2015 Water Budget. Table 1 shows the original budget allocation and the re-allocated amounts. The total consultant contract amount is$419,904,leaving approximately$80,000 for City management, miscellaneous costs and contingency. This purchase wiil replace a 2001 Ford F-450 service truck. Pursuant to BMC 2.76.090, the request for bids requirement "may be waived by written determination by the Director that either the materials, supplies, equipment or services are clearly limited to a single source of supply, or that materials, supplies, equipment or services are subject to special market conditions, involve special facilities or services, or that a bid would not be practical or in the City's best interests under the circumstances, in which instances the purchase price may be best established by direct negotiation." This sole source purchase from Cobalt Truck Equipment provides the specific modifications necessary for use as a sewer/storm maintenance vehicle. Purchasing the truck already outfitted with service boxes and a hydraulic crane reduces the amount of staff labor required to purchase and install these items separately; in addition, purchase from this source also enables the City to get the vehicle into service months sooner than would otherwise be the case. When all of the above issues are considered, and after taking in to account the cost of purchasing the vehicle, service boxes and supplemental equipment separately, it is my determination that sole source negotiated-price procurement of the 2016 F-550 Service Truck from Cobalt Truck Equipment is in the best interest of the City. , , Wurkin or and with our citizens to establish Bremerton as Puget Sound s most beautijul and livuble waterfront city gl ;.-.,`..1.. •;.: !y-., •;,j ( 1'`` l\.v:/I w_✓ www.cobalttruck.com CogAL / I I I{ vl P' Quote Number: 1300058 ' Page 1 of 6 CUSTOMER: CITY of BREMERTON Quote Number: 1300058 CONTACT: Quote Date: 4/30/2015 ADDRESS: 100 Oyster Bay Avenue N Quote valid until: 5/30/2015 Bremerton WA 98312 PHONE: (360)473-5621 Salesperson: Mark Melton FAX: (360)473-5881 Quote Prepared By: Mark Melton Make: Ford Model: F550 Year: 2016 GvwR: 19500 SingIPJDuaI: DU81 Cab to Axle: 60 Cab to Tandem: Wheelbase: 141 Trans: AutomatiC VIN: QUANTITY DESCRIPTION PRICE EACH AMOUNT 1 2015 Ford F-550 4-wheel drive as follows: $46,987.00 - 141"w/b,60"c/a -6.7L V8 Diesel engine -50 state emissions -6-speed automatic transmission with PTO provision -40 gallon aft of axle fuel tank -4.88 ratio limited-slip rear axle - 19,500 lb GVWR -7,000 Ib front GAWR - 14,706 Ib rear GAWR -Upfitter switches -225/70R19.5 all-season tires -(2)front tow hooks -XLT package -Extendable trailer-tow mirrors -Electronic cruise control -Tilt wheel -Air conditioning -AM/FM stereo w/clock -40/20/40-spli seat -Oxford white exterior -Medium stone interior -PTO -Cab Steps -Block Heater 345 W Karcher Road 1607 Irdustrial h'oad 11218 IH-10 East 4620 E Trent Avenue Nampa,ID 83G7 Las Vegas.NV 89102 Co;iverse.TX?8109 Spokane,WA 99212 Phone.800-733-342 Phone 883-25E-9812 Phone. 855-587-7788 Phone. 800-572-43G9 Fax: 208-887-7794 Fax. 702-335-9936 Fax.210-301-2037 Fax. 509-535-4294 '::_----.; :r:"%^; f '.>':.` ; ,,,_-, www.cobalttruck.com CogAL / / / i UC ' Quote PVumber: 1300058 Pa e2of6 QUANTITY DESCRIPTION PRICE EACH AMOUNT 1 IMT DSC20 9'RRF body installed as follows: $20,450.00 $20,450.00 - 108" long x 94"wide x 44"high -Curbside 55"side pack with raised right front compartment to 60" -50"wide cargo area -22"deep compartments -Master locking system -4 shelves RV 1 with divider open forward half of compartment -4 shelves LV 1 —2 shelves LH—4 Shelves LR -2 shelves RR- -Drawer pack 5-3" (RH)right horizontal compartment -2"receiver hitch rated at 2,000 lb.tongue weight, 16,000 Ib.trailer weight, includes(2)safety chain loops -(6)recessed cargo tie-downs -Galvannealed steel construction -Inverted "A" frame understructure -Powder coat finish 3-point,locking rotary T-handle door latches -Stainless steel door hinges -Spring loaded door stops on all vertical doors -(2)rear grab handles - 10"fold down tailgate with single hand latch -21"deep workbench bumper with through compartment -In lieu of standard 14"step bumper -Expanded metal basket with rubber mat -Fully undercoated -LED lights -Mud flaps -Painted urethane, white 1 Crane reinforcement kit installed in standard height service body with 20"deep $1,553.00 $7,553.00 compartments 1 6,000 Ft.-Lbs.Moment Rating $4,210.00 $4,210.00 Maximum Capacity 2,000 Lbs.at 3 Ft. A rush to pass some changes rather than address the full issues seems a haphazard way to approach a problem. Just because current BMC (laws)aren't being followed and mandated policy process not being followed is not a reason to change the BMC on a rushed schedule. I would encourage a slower and more reasoned approach. The BKAT Advisory Board has been defunct or missing for what I am told is around four years (2010)so there should be no rush now. A couple things the council may wish to address is who the local taxpayers should be supporting with it's local taxes. Should BKAT be open to any nonprofit or others across the country? I bring this to your attention due to current membership concerns that have come to light after viewing BKAT and submitting a records request. The membership list received as part of my records request reflects memberships that may not fall within the policy. Is the Council supportive of the current 2014/2015 BKAT approved member The House of Yahweh, commonly known as a cult from Abilene, Texas? Even in light of leaders being charged with child molestation, making death threats to public officials, child labor enslavement and bigamy? Is that type of inembership one that the City Council can support and defend? Who made such decisions and how did that happen? Here are a couple quick links that provide a glimpse. http://www.bipcountryhomepage.com/news/ktab-news/house-of-yahweh-leader-charged-for-makina-death- threats http://www.reporternews.cominews/local-news/house-yahwehs-hawkins-sentenced-30-years Is the City Council supportive of the recent DemocracyNow broadcasting that has aired police violence exceeding that of which current BKAT policy supports. Is the Council supportive of undermining our local police with the deeds of other law enforcement acts on the other side of the country? If that is the case than maybe we should stop our funding for de- esction training_of our officers and_outreach efforts to_bridqe.our community. If BKAT's_policy is that.content_providers are to be members and submit play request then why is DemocracyNow not found on the membership list or any copy of a play request form available via records request? I would encourage the Council to request the annual reports that BMC 2.100.070(d) requires be produced for both the Council and Commissioners. BMC 2.100.070(c}entitles me a venue in which to bring my concerns of programming. When I approached the Executive Director regarding offending programming I was told to take it up with the Advisory Board, an Advisory Board that the director knew well no longer existed. I feel that the director was deceptive, untruthful and in violation of the employee conduct policy in doing so. The county website advertises the BKAT Advisory meeting as held on the 3rd Wednesday of each month. Meeting that don't exist. The BMC 2.100.080 requires such meetings be held at least once monthly and the be held in accordance with city and state laws regarding public meetings. Does BKAT actually have the ability to violate the various BMC's established by the council without consent or notification and approval? If this is the case I would desire a copy of all the BMC's that no longer have force or that can be ignored. As a way of attempting to help put BKAT back on a firm footing that we can all be proud of and one that operates within the established or proposed municipal code, I have volunteered and submitted and application to join the BKAT Advisory Board. I look forward if accepted to helping improve BKAT. Draft policy for production?Suggest operations through the executive director?Or is this board meant more for consideration of programing? I think the mission needs to be clearly lined out. Additionally, I think the Board Chair with the Executive Director should report out to the City Council of Bremerton on an annual basis about what is occurring with BKAT.Viewership, policy direction, programing choices should all be discussed with the City Council, probably during budget preparation. Robert Parker 360-377-6540 office 360-377-2356 fax parker(ctscnet.com i BKAT Breaks Laws Most know of our local public access channel in the county known as BKAT that we help pay for by an added charge to our local cable bills. Most aze probably unfamiliar with the inner working. I recently viewed a government meeting on BKAT which was followed by a program known as DemocracyNow. The show was highlighting the law enforcement shootings around the country but more only in a gotcha style of programming meant more to damage rather than being factually presented in context. I admit that the recent national incidents are concerning but should they be broadcast here locally using our local taxpayer funds in an inflaming manner. That was my beginning question. Reaching out to BKAT's manager about the programming and my concern I was told to take it up with the Citizen Advisory Board. The parting comment was "There needs to be an alternative message around here besides Fox News." I was shocked with the comment thinking that there were many other cable news channels available to counter the manager's statement. I did seek out the Advisory Board to voice my growing concerns only to find out that the Citizen Advisory Board had not been in existence for years, many years. The published BKAT policy and Bremerton Municipal Code (law) speaks of the required board but there isn't one. Now was the manager intentionally deceptive or just outright untruthful? To me, an important question as there appeared to be no way for citizen input or corrections that may not meet the manager's agenda. Now if a citizen was savvy enough to catch the finance committee agenda last week it could be viewed that the ordinance/law that controls BKAT was quietly submitted for changes and rushed through last weeks study session for a revision where citizens are not allowed to speak and forwarded on to this weeks at Bremerton's City Council. That is a lot of hush and rush without any public discussion. Still not addressed are all the broken policies and the law known as BMC 2.100. So what good is a law passed by council or others when staff can break them at will without repercussions. BMC's can be used to throw citizens from their homes in Bremerton as was shown at the last council meeting just not to control the city staff as shown here. Budgets have never been a good defense for breaking the law, just ask the homeless. Robert Parker
