SUMMARY: The last permit needed to access the beach for the Washington Avenue project is the
DNR easement agreement which outlines the terms and conditions the City must comply with in
order to decommission the sewer �ines and leave them in place within the tidal zone. Over the past
several years, DNR has changed its policy toward these easements, providing agreements that are
significantly more detailed and also more expensive. In addition, DNR has set a policy goal of
removing, not leaving in place, decommissioned sewer lines. This document was finalized at 3:00
p.m. today and is, considering all of the elements of the current situation, supported by staff.
Council approval of this agreement is required in order to maintain the Washington Avenue project
schedule.

FISCAL IMPACTS (Include Budgeted Amount): The easement agreement is for no cost if the pipe is
removed within 15 years; otherwise there will be a lump sum payment of$50,250 in year 14.

Move to approve DNR Easement Agreement#51-092390, and authorize the Mayor to finalize and
execute the agreement with substantially the same terms and conditions as presented.
