The new ordinance envisions the City establishing a system to notify owners that repairs are needed, then providing a mechanism for the repairs to be completed. Property owners can make the repairs themselves with a City permit, or request the City make the repairs. The City mechanism to make the repairs is proposed to be an indefinite delivery contract with standard bid prices for sidewalk and driveway repair. If the City makes the repairs through its contractor, property owners would pay the City directly, and the funds would be deposited into the Sidewalk Abatement Fund (see below). If the property owner does not perform the repairs (or pay the City for the repairs), then the City Council may assess a lien on the property for the expense. ATTACHMENTS: Ordinance No. 5276 FISCAL IMPACTS (Include Budgeted Amount): This ordinance proposes to initiate a Sidewalk Abatement Fund which will receive funds from property liens, and property owners who reimburse the City for sidewalk/driveway repairs. However, we anticipate this fund will need to be supplemented with Street funding. $25,000 is recommended as a budget target for 2016.
