Schowrup Re: Enforcement of Ordinance 1792 Zoning Restrictions - Kitsap Way/Shorewood Drive Dear Mr. Scourupp: The City has determined that the following actions at the Kitsap Way/Shorewood Drive site are inconsistent with the conditions of rezoning specified in Ordinance 1972 (attached): 1. 2. A substantial number of the existing trees which were to have been retained in the required perimeter and interior landscape areas, as shown on the approved site plan and described in Ordinance 1792 condi-. tions 8. f (1)-(7), have been removed by grading activities at the site The grading activities now shown on your grading and utility plan will be raising the elevation of portions of the northerly parking areas significantly higher than was proposed at the time of the rezone (as indicated by the presence of several existing trees to remain in the interior of the site on the approved site plan). These raised elevations will almost certainly undermine the effectiveness of the 6- and 8- foot high fence which was required to screen the business development from I adjacent residential uses to the nroth. As a result, the City has determined that you must satisfy the following requirements before any further grading, building or occupancy permits will be issued at this site: 1. Submit five copies of an accurate landscape plan to scale, approved by a privately retained licensed landscape architect, certified Wash- vc ington State Nurseryman or certified Washington State Landscaper, for . Planning and Engineering Department approval. This plan shall indicate: q03 a. Remaining:'existing trees to be retained; b. Remaining existing trees which must be topped or removed in order that they not constitute a safety hazard; c. Measures to be taken to protect remaining existing trees during land alteration and construction. 2 fl DIM APPROVAL 6tM1b AZaWQWWOON 4F COmP1_ f AJCG- Wirlq 6 (19(11 10 4ti (ApLl CANT .- 000ce_ d M07T L G► y ci d. Supplementery native vegetation to be added to the north perimeter ❑ natural area to replace and supplement remaining vegetation. e. Replacement of trees designated for retention on the approved site ❑ plan with comparable trees of the largest size feasible. For example, replacement of a 12 inch diameter evergreen tree should consist of two or more trees whose total trunk diameter is essent- ially equivalent in area to 12 inches and of a similar species typical of Pacific Northwest native vegetation. f. Location of the required fence so as to most effectively screen ❑ light and glare from the buildings and parking area as viewed from adjacent residential properties on the north. Elevation drawings showing the relationship of the northerly parking areas, the fence and the adjacent two residential structures shall be supplied. g. Compliance with all applicable rezone requirements. ❑ Pay the necessary fees for the City to retain a qualifed consultant 's to advise the City as to whether the proposed landscape plan adequately addresses' the aboverequirements. .. This shall include any time necessary to attend any meetings between the City and applicant if the City requires such meetingsin order to work out any problems not adequately addressed by the proposed landscape plan. 3. In addition to the required performance and maintenance assurance devices (Ordinance 1792 9 d. and e.), post a maintenance bond -in -an amount to be determined by the City sufficient to replace the trees and other vegetation which were improperly removed; said bond shall remain in force and effect for a period to be determined bythe City upon consultation with the advisor to the City described above, and shall guarantee that any dead, diseased, stolen or vandalized plant- ings shall be replaced within three months. 4. Provide the City with an agreement granting the City and its agents the right to enter the property and perform any required work remain- ing undone at the expiration of the above required maintenance bond. Seattle, Washington 98168 Attention: Mr. M. Schowrtip MAYOR MORRIE Df Re: Enforcement 'of Ordinance 1792 Zoning Restrictions - Kitsap Way/Shorewood Drive Dear Mr. Scourupp: The City has determined that the following actions at the Kitsap Way/Shorewood Drive site are inconsistent with the conditions of rezoning specified in Ordinance 1972 (attached): 9 A substantial number of the existing trees which were to have been retained in the required perimeter and interior landscape areas, as shown on the approved site plan and described in Ordinance 1792 condi-. tions 8. f (1)-(7), have been removed by grading activities at the site The grading activities now shown on your grading and utility plan will be raising the elevation of portions of the northerly parking areas significantly higher than was proposed at the time of the rezone (as indicated by the presence of several existing trees to remain in the interior of the site on the approved site plan). These raised elevations will almost certainly undermine the effectiveness of the 6- and 8- foot high fence which was required to screen the business development from adjacent residential uses to the nroth. As a result, the City has determined that you must satisfy the following before any further grading, building or occupancy permits will be issued requirements at this site:; 1. Submit five copies of an accurate landscape plan to scale, approved by a privately retained licensed landscape architect, certified Wash - VO ington State Nurseryman or certified Washington State Landscaper, for Planning and Engineering Department approval. This plan shall indicate: a3 a. Remaining existing trees to be retained; b. Remaining existing trees which must be topped or removed in order that they not constitute a safety hazard; c. Measures to be taken to protect remaining existing trees during land alteration and construction. 1 n El n DVT APPROVAL RM'b 2nuufTlolV DF CmPrUC.E' wires iRf7r?nrr_t ti ti 4v °, )*L/CANr 'v ,e mor a, d. I f. ❑ Pay the necessary fees for the City to retain a qualifed consultant ' to advise the City as to whether the proposed landscape plan adequately !^s addresses the above, -,requirements. This shall include any time necessary to attend any meetings between the City and applicant if the City requires such meetings in order to work out any problems not adequately addressed by the proposed landscape plan. 3. In addition to the required performance and maintenance assurance devices (Ordinance 1792 9 d. and e.), post a maintenance bond in an amount to be determined by the City sufficient to replace the trees and other vegetation which were improperly removed; said bond shall remain in force and effect for a period to be. determined bythe City upon consultation with the advisor to the City described above, and shall guarantee that any dead, diseased, stolen or vandalized plant- ings shall be replaced within three months. 4. Provide the City with an agreement granting the City and its agents the right to enter the property and perform any required work remain- ing undone at the expiration of the above required maintenance bond. The strap is punched at 22 -inch intervals its entire length to receive one 8 -penny common nail at each intersected stud. The \call braces are installed at approximately a 45 -degree angle, in a manner similar to the installation of \food let -in braces. Two }.traces installed in opposing directions are equivalent to each \\o(. -,d let -in or cut -in brace replaced. Where installed single. they are equivalent to a let -in brace for loads inducing tension onh. The wall braces arc manufactured in lengths of 10, :2, 14, or f6 feet G. Type "MB" — Metal Bridging: The metal bridging consists of No. 16 gauge steel conforming to A-570 Grade D as specified in U.B.C. Standard No. 27-1. The metal bridging is formed With right angle sections having ',z -inch -wide legs Each end of the section is flattened for a I1`t-inch length, and bent \with respect to the center angle section so as to bear against the vertical side of a ioist. The flattened ends are punched for two 8 -penny- common half -nails. The bridging is installed by nailing the upper end of the top edge of one joist face, bending the lower end of the bridg- ing over to the lower face of the adjacent joist, and then nailing it into place after the floor or subfloor has been nailed. The bridging is satisfactory for use betv.-cen joists or rafters un to 16 inches in denth with a 24 -inch maximum spacing. The bridging is to he in- stalled in pairs, and at snacings or locations required by the code. H. The Act also requires that an Environmental Impact'Statement be pre- pared for all major actions significantly affecting the quality of the environment. The purpose of this checklist is to help the agencies involved determine whether or not a proposal is such a major action. Please answer -the following questions as completely as you can with the information presently available to you. Where explan ations of your answers are required, or where you believe an explanation would be helpful to government decision makers; include your explanation on additional pages. (All yes and maybe answers require an explanation. Use quantitative informa- tion in your answers where applicable.) You should .include references to any reports or studies of which you are aware and which are relevant to the answers you provide. Complete answers to these questions now will help all agencies involved with your proposal to undertake the required environ- mental review without unnecessary delay. The following questions apply to your total proposal, not just to the license for which you are currently applying or the pro- posal for which approval is sought. Your answers should include the secondary impacts which will be caused by. your proposal when it is completed, even though completion may not occur until some- time in the future. This will allow all of the agencies which will be involved to complete their environmental review now, with- out duplicating paperwork in the future. NOTE: This is a standard form being used by all. state and local agencies in the State of Washington for various types of proposals. Many of the questions may not apply to your proposal. If a ques- tion does not apply, just answer it "no" and continue on to the next question. Seattle, Washington 98168 Attention: Mr. M. Schowrup MAYOR MORRIE DAWKINS Re: Enforcement of Ordinance 1792 Zoning Restrictions - Kitsap Way/Shorewood Drive Dear Mr. Scourupp: The City has determined that the following actions at the Kitsap Way/Shorewood Drive site are inconsistent with the conditions of rezoning specified in Ordinance 1972 (attached): 1. A substantial number of the existing trees which were to have been retained in the required perimeter and interior landscape areas, as shown on the approved site plan and described in Ordinance 1792 condi tions 8. f (1)-(7), have been removed by grading activities at the site. 2. The grading activities now shown on your grading and utility plan will be raising the elevation of portions of the northerly parking areas significantly higher than was proposed at the time of the rezone (as indicated by the presence of several existing trees to remain in the interior of the site on the approved site plan). These raised -elevations will almost certainly undermine the effectiveness of the 6- and 8- foot high fence which was required to screen the business development from adjacent residential uses to the nroth. As a result, the City has'determined that you must satisfy the following requirements before any further grading, building or occupancy permits will be issued at this site: Gateway to the Olympics and Home of the Puget Sound Naval Shipyard r Seattle Realty Re: Enforcement of Ordinance 1792 Zoning Restrictions - Kitsap Way/Shorewood Drive page 2 1. Submit five copies of an accurate landscape plan to scale, approved by a privately retained licensed landscape architect, certified Wash- ington State Nurseryman or certified Washington State Landscaper, for Planning and Engineering Department approval. This plan shall indicate: a. Remaining existing trees to be retained; b. Remaining existing trees which must be topped or removed in order that they not constitute a safety hazard; c. Measures to be taken to protect remaining existing trees during land alteration and construction. d. Supplementery native vegetation to be added to the north perimeter natural area to replace and supplement remaining vegetation. e. Replacement of trees designated for retention on the approved site plan with comparable trees of the largest size feasible. For example, replacement of a 12 inch diameter evergreen tree should consist of two or more trees whose total trunk diameter is essent- ially equivalent in area to 12 inches and of a similar species typical of Pacific Northwest native vegetation. f. Location of the required fence so as to most effectively screen light and glare from the buildings and parking area as viewed from adjacent residential properties on the north. Elevation drawings showing the relationship of the northerly parking areas, the fence and the adjacent two residential structures shall be supplied. g. Compliance with all applicable rezone requirements. 2. Pay the necessary fees for the City to retain a qualifed consultant to advise the City as to whether the proposed landscape plan adequately addresses -the above•,requfirements.. This shall include any time necessary to attend any meetings between the City and applicant if the City requires such meetings in order to work out any problems not adequately addressed by the proposed landscape plan. Seattle Realty Re: Enforcement of Ordinance 1792 Zoning Restrictions Kitsap Way/Shorewood Drive page 3 3. In addition to the required performance and maintenance assurance devices (Ordinance 1792 9 d. -and e.), post a maintenance bond in an amount to be determined by the City sufficient to replace the trees and other vegetation which were improperly removed; said bond shall remain in force and effect for a period to be determined bythe City upon consultation with the advisor to the City described above, and shall guarantee that any dead, diseased, stolen or vandalized plant- ings shall be replaced within three months. 4. Provide the City with an agreement granting the City, andits agents the right to enter the property and perform any required work remain- ing undone at the expiration of the above required maintenance bond. You will see that the fill dirt is removed from the base of the trees in the north perimeter screening areas at the earlist possible time to assure that the health of those trees is not further endangered. 6. Any jogs of the eight foot fence within the north perimeter screening area will jog to the south whenever feasible to provide maximum screening of the site as viewed from the north. 7. KW: jg Please reply on reverse August 31, 1983 Mr. Bill Schourup Seattle Realty, Inc. 1220 116th Ave. N.E. Bellevue, WA 98004 Dear Bill: On March 25, 1983, you met with Dick Shrum and Ron Shipley of my office, and David Huffman, our architect, to review completion of the Bremerton project. As a result of that meeting, a letter dated April 4, 1983 ( copy attached ), spelling out the relative responsibilities of the parties was sent to you. Our people have relied upon you to complete the items listed therein and now set forth below by August 15. This was to ensure that an occupancy permit could be issued for the Super 8 Motel in a timely manner. The items that you agreed to complete are all items. which are part of your Plat Commitment from the Planning Commission. The ones that we are mainly concerned about at this time are as follows: I. Completion of left and right hand turn lanes on Kitsap Way and Shorewood Drive, as applicable. 2. Completion of islands or other traffic regulating barriers. 3. Submission of plans for the construction of perimeter sidewalks on Kitsap Way and Shorewood Drive, as well as the completion thereof. 4. Submission of landscaping plans and a bond, insuring both construction and maintenance. 5. Completion of access roads from Shorewood Drive to the motel site. SU P -ER-- V MOTEIS NO HJT, INC. Completion of storm drains allowing for retention of storm water off of our northerly most lot. In addition, you were to tie into our storm drains and absorb part of the cost thereof. 7. Completion of sewer hook-up in accordance with the City Engineering and in agreement with Super 8 Motels. The agreement for completing the above mentioned items was based upon a date of August 15. It is now August 31 and none of these items have been completed. The Bremerton Super 8 will be ready for occupancy by October 10, 1983. We have been assured by representatives of the Planning Commission that we have complied with and met all of the requirements to date placed upon us by the Planning Corrmission. Once again, our projected date for application for occupancy permit is no later than October 10, 1983. 1 would simply prefer to have you complete these things in a time y manner, but clearly, we have a very difficult situation in the event of your failure to perform. If the Bremerton Super 8 is denied an Occupancy Permit on October 10, 1983, we will be looking to you for damages for interferring with our quiet enjoyment of our leasehold interest. SHERL BRADE FM: KAY WILSON, ACTING PLANNING DIRECTOR SJ: TREE REMOVAL -- SEATTLE REALTY REZONE SITE MAYOR MORRIE DAWKINS September 30, 1983 (ORDINANCE 3682 AS AMENDED) When the Seattle Realty site was cleared early this summer, a large number of trees which were to have been preserved, as required by the Approved Site Plan, were removed. As a result the Planning Department issued instructions for tree replacement in a memo to Seattle Realty, Inc. dated June 10, 1983, of which a copy was sent to you. Seattle Realty, Inc. subsequently retained Thomas L. Berger Associates P.S. to provide a tree replacement landscape plan for approval as required by the 6/10/83 memo before further construction or occupancy permits were issued at the site. Berger proposed that the City consider allowing some of the large Western Red Cedars still remaining at the time on the Denny's portion of the site to be counted toward the one for one replacement of trees which were to have been saved. The Planning Department agreed that this would be appropriate, and Berger red -tagged eleven large Western Red Cedars for potential incorporation into the replacement plan. He agreed to contact Denny's to try to work out a minor redesign of the affected driveway, parking and landscape areas, and subsequently submitted a landscape plan proposing such a redesign to save the cluster of six trees at the southwest corner of the restaurant building. This proposal was approved by the City Fire Department but disapproved by the Engineering Department because of the impact on internal circulation. I notified you of the Engineering Department's concern late last week and also stated that because your building permit was issued for a landscape plan which did not include preservation of the subject trees, you were free to cut them at any time. This memo is issued to confirm these events in writing, as you requested. It is our understanding from the 9/16/83 Thomas L. Berger Associates P.S. memo addressed to Kay Wilson from Scott Woodcock that you are willing to substitute 12' to 25' Douglas Firs for the 12 Austrian Pines on yourapproved landscape plan. We strongly encourage you to do so in order to promote a unified appearance at the total site, and hereby approve of this substitution if you should choose to do this. s, DENNY'S RESTAURANT 9/30/83 We have certainly appreciated your happy to continue to work with you schedule. We continue to encourage KW:bdw cooperation and patience in this process and will be in any way that we can to expedite your construction you to save any of the existing trees possible. cc: William Smith, 1103 Shorewood Drive Calvin Johnson, 1010 Brentwood Drive Bayshore West Homeowner's Association, 924 Shorewood Drive Denny's Restaurant, (Barbara Lamb) P.O. Seattle, Washington 98168 Attention: Mr. M. Schowrtip MAYOR MORRIE Di Re: Enforcement of Ordinance 1792 Zoning Restrictions - Kitsap Way/Shorewood Drive Dear Mr. Scourupp: The City has determined that the Drive site are inconsistent with Ordinance 1972 (attached): I following actions at the Kitsap Way/Shorewood the conditions of rezoning specified in A substantial number of the existing trees which were to have been retained in the required perimeter and interior landscape areas, as shown on the approved site plan and described in Ordinance 1792 condi- tions 8. f (1)-(7), have been removed by grading activities at the site The grading activities now shown on your grading and utility plan will be raising the elevation of portions of the northerly parking areas significantly higher than was proposed at the time of the rezone (as indicated by the presence of several existing trees to remain in the interior of the site on the approved site plan). These raised elevations will almost certainly undermine the effectiveness of the 6- and 8- foot high fence which was required to screen the business development from adjacent residential uses to the nroth. As a result, the City has determined that you must satisfy the following requirements before any further grading, building or occupancy permits will be issued at this site:] 1. V X03 Submit five copies of an accurate landscape plan to scale, approved by a privately retained licensed landscape architect, certified Wash- ington State Nurseryman or certified Washington State Landscaper, for Planning and Engineering.; Department approval.
