SUMMARY STATEMENT AND REQUIREMENT FOR COUNCIL ACTION: APPROVED BY COUNCIL PRE>>DENT FOR SUBMITI~j ) COUNCIL PRESIDENT C~ d~~ City staffhas initiated the process to vacate a portion of Shore Drive between Perry Avenue and Ironsides Avenue. A hearing date of March 8, 2000 was set by City Council on February 8, 2000 to hear this request for vacation. This right-of-way consists of approximately 265 feet long by 10 feet wide of undeveloped right-of-way along the south side of the right-of-way. Both the City and the County have inaccurately described this right-of-way in the past as a 50-foot right-of-way. Existing properties abutting this right-of-way have structures built to this' 50-foot right-of-way line and are encroaching on City right-of-way. Posting of the hearing notices and mailings to the adjacent property have been completed in accordance with the Bremerton Municipal Code. Specific items for City Council consideration are outlined in the Staff Report. The request before the City Council is to approve, disapprove, or modify this vacation of a portion of Shore Drive. 8. Applicant: City of Bremerton B. Location: A 10 foot wide by 265 foot long section of right-of-way located along the south margin of Shore Drive between Perry Avenue and lronsides Avenue. C. Attachment: Exhibit showing the Vacation Area BACKGROUND The Department of Public Works and Utilities proposes vacating a portion of Shore Drive right-of-way. Both the City and the County have inaccurately described this right- of-way in the past as a 50-foot right-of-way. The original plat for this area allows room for interpretation of the width. It has recently become evident that the right-of-way should actually be 60 feet wide. Existing properties that abut this right-of-way have structures that were built to the 50-foot right-of-way line and are actually encroaching on City right-of-way. RIGHT-OF-WAY CONDITIONS ' . These issues and the staff position are: 1. Whether the street, alley or portion thereof is no longer required for public use and vacation of the described portion will better serve the public good. Staff Position: This portion of Shore Drive is not required for public use. The street is well defined by a concrete wall on the north side and existing residences and garages on the south side. No widening of Shore Drive is anticipated in this area. 2. Whether the vacation is consi~tent with the City Comprehensive Plan. Staff Position: The proposed vacation does not conflict with the Comprehensive Plan. 3. Whether continued use of the proposed vacation as a public way is not of such public benefit as to justify the costs of maintenance. Staff Position: This is a vegetated portion of the right-of-way. The maintenance has been and will remain the responsibility of the adjacent property owner. 4. Whether substitution of a new and different thoroughfare would be more useful to the public. Staff Position: There are no other proposed circulation routes. 5. Whether conditions may so change in the future as to provide a greater public use or need than presently exists. Staff Position: No future use of this portion of right-of-way is anticipated. Again the paving section is well defined by existing structures. 6. Whether objections to the proposed vacation are made by owners of private property abutting the same. Staff Position: A single written objection has been received by an adjacent property owner. February 24, 2000 Shore Drive Vacation Page 2 of 4 SHORELINE ACCESS This portion of right-of-way does not provide shoreline access. UTILITIES All private utility companies have been contacted. There are no utilities in this area. SUFFICIENCY OF SIGNATURES N/A This is a City initiated vacation. COMPENSATION Compensation is not required since this vacation would simply place the right-of-way line where it has long been considered to be. STAFF RECOMMENDATION No comments were received from Police, Fire, or Community Development staff. Staff recommends that this Street Vacation be approved as requested without modification.
