AN ORDINANCE Vacating the 625 foot length by 7.5 foot wide of
undeveloped alley located east of Whitney Avenue between 15th Street
and 13th Street.
WHEREAS, the City of Bremerton initiated the vacation process of the 7.5 feet
wide portion of the undeveloped right-of-way; and
WHEREAS, notice has been posted and published according to law; and
WHEREAS, the City Council finds that the portion of the right-of-way set forth
herein is not needed for present or future use and should be vacated to allow the
abutting property owners to maintain the parcel, now therefore
THE CITY OF BREMERTON DOES HEREBY ORDAIN:
Section 1. Vacation. The following alley is hereby vacated to the adjoining
property owners.

The Alley dedicated in Volume 5 of deeds, Page 1, records of Kitsap County, Washington, lying
between 1 3th Street and 15th Street and abutting the east boundary of the Plat of Berry H. Hurt's
Addition to the City of Bremerton, recorded in Volume. 3, of plats Page 28, records of Kitsap
County, Washington, situate in the Northwest quarter of Section 14, Township 24 North, Range
1 East, W.M., Kitsap County, Washington.
Section 2. Reservation of Easements. This vacation shall have no affect
on public utility easements or private easements which have been established within the
rights-of-way subject to this vacation ordinance. Easements are reserved for all public
utilities which have been established within the right-of-way subject to this vacation
ordinance.
Section 3. Effective date. This vacation shall become effective ten (10) days
from passage and publication.

The City of Bremerton has proposed the vacation of the alley east of Whitney Avenue between 13th Street and 15th
Street. On May 26, 1999 Council passed Resolution #2706 setting a hearing date of July 7, 1999 for this proposed
vacation. In accordance with Washington State Lawall the postings and notifications have been made. Less than 50%
of the abutting property owners have submitted written objections to the City Clerk's office. The action before the
Council is to approve, disapprove, or modify this vacation of the alley.

Corbet Drive, and
that portion of 19th Street east of N. Wycoff Avenue and west of Callow Avenue, and
that portion of Taft Avenue between 19th Street and 20th Street, and
that portion of an Alley north of 13th and south of 15th Street and west of the Ivy
Green Cemetery, and
that portion ofFord Avenue between Kitsap Way and 13th and setting a hearing
date for these vacations.
BE IT RESOLVED BY THE BREMERTON CITY COUNCIL THAT:
1. The City hereby proposes the vacation of the following rights-of-way within
the City, one-half of each right-of-way as originally platted to each abutting property:
SEE ATTACHED EXHIBIT "A"
2. A public hearing will be held on July 7, 1999 at 6:00 PM or later at the
Bremerton City Hall, 239 Fourth Street, Bremerton, Washington to take public comment
or consider written objections to the vacation.
3. If fifty percent or more of property. owners abutting said right-of-way file
written objections to this action prior to the time set for public hearing herein, the hearing
shall be canceled and there shall be no further proceedings under this resolution.

4. SUMMARY STATEMENT AND REQUIREMENT FOR COUNCIL ACTION:
The City Council is being requested to vacate rights of way in five different locations of the City. These rights of way
have been identified by City staff as unneeded for right of way purposes. Most of these ROWs are undeveloped with
no foreseeable need for improvements. The vacations include 13th Street east of Corbet Dr., 19th Street east of N.
Wycoff Ave. and west of Callow Ave., Taft Avenue between 19th St. and 20th St., an alley north of 13th St and south of
15th St. and bordering Ivy Green Cemetery, and Ford Avenue between Kitsap Way and 13th St. The City will retain
easements for all utilities in these ROWs. The hearing for these ROW vacations is proposed to be Ju 1 y - 7, 1999
Posting of the hearing notices and mailings to adjacent land owners will occur as required by the Bremerton Municipal
Code.
