J City Council Reg. Mtg. Minutes Wednesday, April 6, 2005 Page 2 of 5 Phil Williams, Public Works and Utilities Director was available to respond to questions, President NYQren suggested that the proceedings be terminated until an appraisal of the property is received. He also recommended that after it is determined whether or not to surplus the property, a process will need to be established on receiving bids, and then a new hearing may be set. ROQer Ryno supported preservation of the Tracy ton watershed as key areas for migratory waterfowl and believed that housing is not an appropriate use of the land. He suggested that if the property were to be sold that the land be developed carefully to not disturb the habitat. Mr. Hill also supported preservation of open space and suggested that the area be developed as a walking park so people could experience wilderness. Jim Trainer, Kitsap Trees presented a tree cutting to the Council and encouraged Council Members to protect the watershed. Glen Carden believed that preserving the property would benefit many people in the future and argued that if the City will help clean up an area next to the shipyard perhaps the City should also consider protecting the watershed rather than developing it. DouQ Belchard had witnessed wildlife in the watershed and encouraged Council to not develop the property. Sidney Cotton expressed concerns over removing old growth and asked that an environmental impact study be done before considering development. 6:02:15 M/S/C/U (Arends/Shepherd) Move to terminate the pending proceedings regarding the surplusing and sale to Bealko, Inc. of the public utility property commonly known as the Tracy ton property consisting of approximately 38 acres for $2.9 million as set forth in Resolution No. 2956, upon which no action will be taken. 6B - RESOLUTION NO. 2960. President Nvoren indicated that because this was a Closed Record Hearing, all Council members should now give consideration at to whether they have 1) demonstrated bias or prejudice for or against any party to the proceedings,' 2) a direct or indirect monetary interest in the outcome of the proceedings/ 3) a prejudgment of the issue prior to hearing the facts on the recont. or 4) ex parte contact with any individual, excluding administrative staff, with regard to an issue prior to the hearing. Mr. Grumbach answered that visitors and residents would use the parking strip which would be located in the right-of-way, Mr. NVQren suggested that it might be appropriate to review our engineering design standards. Mr. Short requested clarification on the plat map. Mr. Coleman summarized that the code requires a certain number of off-site, on-street parking spaces and this project meets that requirement. Mr. NVQren asked if stormwater issues will be resolved. Mr. Grumbach stated that those details will be reviewed by the engineering staff. 6:20:40 M/S/C/U (Short/Priest) Move to pass Resolution No. 2960 approving and adopting the Findings, Conclusions, and Recommendation of the Administrative Hearing Examiner and approve the preliminary plat for Sylvan Plat subject to the proposed conditions. 7A APPROVAL OF 2005 CDBG "OFF CYCLE" FUNDING REQUEST FOR THE KITSAP COUNTY COMMUNITY DEVELOPMENT CORPORATION SMALL BUSINESS REVOLVING LOAN PROGRAM (#)'.B05 Oa9): 7B -lOCAL AGENCY STANDARD CONSULTANT AGREEMENT WITH "SAMPLEY CONSULTING" FOR THE DOWNTOWN PEDESTRIAN/BTC ACCESS IMPROVEMENT PROJECT (#AB05-090): Phil Williams, Public Works and Utilities Director, mentioned that the City requires project coordination assistance for the Downtown Pedestrian IBTC Access Improvement Project. Retaining the services of W. Eugene Sampley dba Sampley Consulting will provide the expertise necessary to maintain project continuity, scope, and schedule. A Local Agency Standard Consultant Agreement for federally funded projects has been negotiated with Sampley Consulting for the Downtown Pedestrianl BTC Access Improvement Project for total authorized amount not to exceed $120,000. He clarified that Lynn Price of the Engineering City Council Reg. Mtg. Mr. NVQren stated that a letter was received by Del Knauss and will be made part of the record. There were no comments from the public. Mr. Lubovich stated that the contract term should be corrected to read "through 2006". Mr. Short mentioned that the contract would be pro-rated for the actual time work is being done. Mr. Williams added that when the design phase is done, then the project contract is done. Ms. Arends believed that the contract amount is reasonable and thought that it was important to have the City's interests protected. Ms. Robinson asked if there is a conflict by setting up a contract with the City but paying for the contract with federal funding; and expressed concerns that the project has not been accepted as part of the State's list of projects. Mr. Williams stated that the purpose of the contract is to protect the City's interests and since filling the position with a current employee is not an option, contracting the position is the only option at this point. Mr. McConnell emphasized that if the project is a State project then the State should run the project and all associated contracts, Mr. Shepherd asked if the project is part of the State's Capital Improvement Plan. Mr. Williams answered yes. 6:34:50 M/S/C (Arends/Short) Move to approve the Local Agency Standard Consultant Agreement with Sampley Consulting for the Downtown Pedestrian/BTC Access Improvement Project in the amount not to exceed $120,000, and authorize the Mayor to finalize and execute the necessary contract documents for the agreement. FISCALIBUDGET: OPERATIONS: COUNCIL PRESIDENT: CONSENT AGENDA 0 COUNCIL ACTION: D Approve D Deny 0 Table D Continue D No Action DEPARTMENT OF COMMUNITY DEVELOPMENT VlEMORANDUM To: President Nygren and Members, Bremerton City Council From: Chris Hugo, Director Date: March 9, 2005 Re: PROPOSED HIRE OF HUGH MORGAN AS COBG PROG AOMINSTRATOR The Administration proposes to hire Mr. Morgan to fill the vacant COBG Programs Administrator position at higher than entry pay rate and asks the Council's approval. We have been working to fill this position for over a month, and Mr. Morgan is the most capable professional that we interviewed from a group of six finalists. POSITION BACKGROUND Initially the Coordinator and the Administrator shared the same title, "Administrative Analyst." During the process to set the 2003 Budget, these two positions were renamed to "CDBG Programs Coordinator" and "COBG Programs Administrator," It was proposed that these be changed to more clearly identify the job function and to set a minor staff hierarchy within the COBG program function. The Administrator position is becoming vacant with the resignation of Michelle Eichhorn, on April 6th, 2005. SELECTION PROCESS We advertised the vacancy in February and interviewed six finalists in early March, Of those, two individuals stood out with the professional characteristics that we were seeking, Michelle Eichhorn, Cathy Johnson and I conducted interviews with all applicants and concluded that Mr. Morgan's experience was appropriate for the position and that he had professional skills and experience that would be of great benefit to the City and Department. SALARY NEGOTIATION At the conclusion of the interview with Mr. Morgan, we discussed conditions of employment. Because of his level of professional experience, he proposed a starting salary at rate above Rate 1 in Pay band 11. I explained the City procedures to hire above the entl)' rate. 1 -L JUSTIFICATION Rate 1, Pay band 1.1 is the entry. level pay rate for the COBG Program Administrator position. In addition to attaining a bachelor's degree from the University of Arizona, Mr. Morgan has gained over 30 years of professional experience which include 15 years of direct experience working within the CDBG program at Pierce County Washington. Within this capacity he has gained valuable knowledge in housing rehabilitation, COBG contract compliance and project management. His work history is not appropriate for an entry-level hire. The salary issue has been negotiated to this final proposal. Mr. Morgan has personal reasons to continue his professional career in Bremerton. He recently received a substantial pay increase in his current position and is our best and only choice for filling the vacant position in a timely manner, Since Michelle Eichhorn will be departing the City April 6th it is imperative that the position be filled for the necessary program training to begin. In addition, the higher starting salary is fully off-set by the recent hire of the COSG Coordinator at Rate 1, although budgeted at a mid-level rate. RECOMMENDATION Based on his education, experience and anticipated value to the city in this position and as a personable and skilled public servant, I recommend that Mr. Morgan be hired at a Rate above Rate 1, Pay band 11. .
