SUMMARY: On July 10th the city was awarded a $40,000 no match grant from the WA State
Department of Ecology allowing Parks and Recreation to irrigate the Evergreen Park parking lot
planting islands and perform other work essential to the operational efficiency of the Evergreen
Rotary Park Renovation Project. On August 6t' Council approved Change Order No. 2 with Pivetta
Brothers Construction, Inc. in the amount of$14,098.39 to perform portions of this work. Meanwhile,
in the course of preparing the western most parking lot planting islands for irrigation city crews
encountered an underground obstruction blocking progress of the city's small bore tunneling
equipment. The recommended remedy is to have the contractor(Pivetta Brothers) excavate through
the obstruction, install irrigation sleeving and patch the disturbed parking lot asphalt.
The Parks Department seeks the authority to increase the Pivetta Brothers contract by$5,473.04 to
accomplish this work, referred to as Change Order No. 3. The cost of Change Order No. 3 will be
paid for by the no match, $40,000 Department of Ecology grant. The original Pivetta Brothers
Evergreen Rotary Park Renovation Contract is $104,899.52. The amended Contract amount
including the cost of Change Orders No. 1, No. 2 and No. 3 totals $138,143.83.

RECOMMENDED MOTION:
Move to approve Change Order No. 3 in the amount of$5,473.04 to the Contract with Pivetta
Brothers Construction, Inc. for Evergreen Rotary Park Renovations and authorize the Mayor to
finalize and execute the change order with substantially the same terms and conditions as presented.
