SUBJECT: PUBLIC HEARING AND Committee Meeting Date: February 23rd, 2005 RESOLUTION ON SURPLUS AND SALE COUNCIL MEETING Date: -Mareh 2nd, 2005- '/-- {o-05 OF PUBLIC UTILITY PROPERTY Department: Public Works & Utilities Presenter: Phil Williams Phone: 473-5315 SUMMARY: The City received an offer from Bealko, Inc. to purchase the Tracyton Watershed in late November, 2004. The unsolicited offer was taken to the City Council for consideration on December 22, 2004. Staff recommendation at that time was to declare the property surplus and authorize the Mayor to sign a purchase and sale agreement. The Council directed staff to work with the neighbors who had expressed concerns over the sale to conduct a public informational meeting near the site and then place the item back on the council agenda for re-consideration. That meeting was held on January 27th and attended by approx. 40 people. The property is not currently used for public utility service nor will it be required for providing public utility service in the future. In the opinion of staff the offer to purchase the property is reflective of its fair market value. Staff recommends the purchase and sale agreement be signed and if the sale is closed that any remaining concerns be addressed during the required environmental reviews that will be conducted during the development process itself. ATTACHMENTS: Summary of 1127/05 Meeting, Resolution and Memo from City Attorney FISCAL IMP ACTS (Include Budgeted Amount): The public utility would receive the sum of $2,900,000 (less fees and costs) from the sale of the property and the property would be returned to the tax rolls.
