SUMMARY: 606 Lorax, LLC will begin construction on the apartment project in the near future. Use
of the airspace above Burwell Street and the 4 Street alley is required by 606 Lorax, LLC for
construction, operation, ownership and maintenance of the project. The proposed Air Rights
Easements grants 606 Lorax, LLC use of certain air space for balconies and related structures.

RECOMMENDED MOTION:
Move to approve the Air Rights Easements granted to 606 Lorax, LLC and authorize the Mayor to
finalize and execute the easements with substantially the same terms and conditions as presented.
The granting of these easements is conditioned upon 606 Lorax, LLC closing on the purchase of the
pad and the building permit for the proposed project, permit number BB1400245, is ready to issue.
