SUMMARY: The original grant application for the project has the City responsible for construction of
a ten foot sidewalk on the west side of the roadway along with other roadway improvements, and no
sidewalk on the east side. In public meetings and communication with the Transportation
Improvement Board (TIB) personnel, strong support was voiced for the project to construct a
sidewalk on the east side of the roadway. In the area just south of E. 18 Street, the City has
inadequate right of way to construct the sidewalk. In discussions with the adjacent property owner,
John Stephanus, he has agreed to convey sufficient right of way to adjust the roadway slightly west
and allow for the sidewalk to be constructed. This conveyance is being done in exchange for City
forces removing the former Maple Leaf Tavern located on the property.

FISCAL IMPACTS (Include Budgeted Amount): Total cost to the City for completing the demolition
and removal of the structure, asbestos survey and removal, recording conveying documents, and
negotiations is $18,000. There are funds budgeted within the project and department budgets.

RECOMMENDED MOTION: Move to approve the purchase and sale agreement for the exchange of
services for additional right of way for the LWW project and authorize the Mayor to finalize and
execute the agreement with substantially the same terms and conditions as presented.
