This purchase would replace the two existing Alfa -Laval spiral heat exchangers. Pursuant to BMC 2.76.090 (sole sourcing), the request for bids requirement "may be waived by written determination by the Director that either the materials, supplies, equipment or services are clearly limited to a single source of supply, or that materials, supplies, equipment or services are subject to special market conditions, involve special facilities or services, or that a bid would not be practical or in the City's best interests under the circumstances, in which instances the purchase price may be best established by direct negotiation." The direct purchase from Alfa -Laval Inc. without going out to bid is based on size limitations and piping configurations. It is not possible to reconfigure piping to allow another style or type (rectangular, plate) of heat exchanger, due to space limitations imposed by the configuration of the existing digester solids and hot water piping. Additionally, due to the access and safety requirements for the cleaning of the heat exchangers, we are physically unable to Install another type (rectangular, plate) of heat exchanger. When all of the above constraints are considered, and after considering the cost of reconfiguring the digester solids and hot water piping system, it is my determination that sole source negotiated -price procurement of the two (2) Alfa - Laval spiral heat exchangers is in the best interest of the City. For reference, BMC 2.12 contains the following provisions: 2.12.010 ESTABLISHED - APPOINTMENT AND TERMS. There is established a planning commission which shall be appointed by the mayor and approved by the city council The planning commission shall consist of seven members who shall be citizens of the United States who are residents of the City, unless a qualified resident is not available The term of office shall be for four years Members shall be appointed for staggered terms so that at least one member shall be appointed annually. The members shall serve without compensation. (Ord. 4563, Amended, 08/22/1996; Ord. 4069 §1, 1986) 1. The second sentence of 2.12.010 refers to a "qualified resident" yet there is no definition of what a qualified resident is. What qualifications are necessary to apply for and be considered for appointment to the planning commission? 2. The same sentence states: "...unless a qualified resident is not available." What are the "non- resident" qualifications to fill a vacancy on the planning commission? 3. BMC 2.12 contains no requirement for active announcement of an opening on the planning commission so that "qualified residents" may become aware of the opportunity and the City may have a broader selection of applicants from which to fill a vacancy. Why is the administration not required to actively advertise to fill any vacancy on planning commission or for any other board /commission or committee? - -Roy Runyon 1 Lori Smith From: Colleen Smidt <colleensmidt@gmad com> Sent: Wednesday, February 05, 2014 12 21 PM To- Patty Lent, Andrea Spencer, City Council Subject. and Bay Vista Preserve), one stormwater tract and right -of -ways City Council approval will allow the separation of the lot, which will enable the developer to apply for building permits to construct commercial, mixed -use residential, and /or residential structures, as outlined in the Bay Vista Subarea Plan BACKGROUND INFORMATION: The Bay Vista Subarea Plan was approved by City Council with Ordinance 5077 on February 25, 2009 With the Subarea Plan to regulate the development regulations and uses, the project received Preliminary Plat approval on July 9, 2009 from the Administrative Hearing Examiner However, as the 82 -acre site was being developed, market conditions and site constraints had made the regulations of the existing Subarea Plan difficult to implement After completing the first four phases, which included Winco, the residential area to the south and northwestern portion of the lot, the Bay Vista Summit and the lot currently undergoing the construction of the senior housing complex, the applicant, Bremerton Housing Authority (BHA), applied to revise the Bay Vista Subarea Plan in 2012 BHA proposed the amendments to the Bay Vista Subarea Plan that included revise permitted land uses to reflect land use zones that were condensed, revise complex Code requirements in Subarea Plan to more resemble the City of Bremerton Zoning Code, and alter landscaping, signage and parking requirements which will still comply with overall policies and goals of the existing Bay Vista Subarea Plan City Council approved the update to the Subarea Plan on December 19, 2012 under Ordinance 5202 To verify compliance with the updated Subarea Plan and to subdivide the lots to larger lots, BHA applied for a Preliminary Plat Amendment in the Summer of 2013 to be have the revisions reviewed by the Hearing Examiner The Hearing Examiner approved the revisions to the preliminary plat map as complaint with the Bay Vista Subarea Plan on December 26, 2013 The Hearing Examiner approval stipulated that final approval would be granted only when specific conditions were met, such as infrastructure improvements (roads, sidewalks, street fighting, utilities, and landscaping) The Engineering and Planning Departments have reviewed this phase of the plat and agree that the conditions applicable have been met Staff finds this plat ready for recording and therefore recommends that this phase of the Final Plat be approved See Exhibit A of the proposed resolution for the proposed lots location within Bay Vista PROCESS: Final Plat Approval is required to ensure the project has met MEETING Date February 5, 2014 Acceleration Department PW &U Presenter Knuckey Phone 360 473 2376 SUMMARY- The City awarded the contract to RV Associates for construction of the Pacific Avenue — 6 to 11 Street Improvements in May, 2013 Due primarily to differing site conditions resulting in incorporation of material quantities beyond the proposal amount, costs on the project have increased to the point that a budget adjustment is necessary Related to this, the projected transfer of funds from the Water and Wastewater Utility Capital funds also require adjustment In addition, staff have coordinated a proposed change order with RV Associates to accelerate substantial completion of the project to April 18, 2014 Finally, upon completion of the work, a Final Change Order will be executed to reconcile actual field quantities with the bid quantities which is expected to exceed the Administrative Change Order authority of the Mayor ATTACHMENTS Council Summary, Pacific Avenue Budget FUNDING, AND PROJECT ACCELERATION COUNCIL SUMMARY Background The Pacific Avenue 6 th -11 Project has been under construction since May 2013 In addition to the very visible streetscape improvements, the project also installs buried electrical conduits both for the undergroundmg of power between 6 th and 9 th streets that is included in the project scope, but also installs empty (blank) conduits throughout the project for future uses The project additionally replaces substandard sewer mains and laterals, as well as substandard water mains and service lines Additional Change Order Authorization During installation of the utilities, poor clay soils were uncovered that were more extensive than estimates made during design As a result, significant extra excavation was necessary which increased related work items resulting in increased cost to the Water and Wastewater Utilities These soft sods also resulted in a need for additional crushed rock base material under the new roadway, resulting in additional cost to the street portion of the work which is funded by a combination of Grant Funds and the General Fund BMC 2 76 110 provides for administrative change order approval authority up to $200,000, change orders approved to date total $174,834 43, and are primarily due to the use of quantities of unit bid items in excess of the bid amount due to differing site conditions Based on work completed and projected costs of work yet to be done, the total cost of the work to RV Associates is estimated at $3,650,750, not including the proposed $18,000 change order which is discussed separately below The requested action before Council is approval of additional Administrative Change Order Authority for the Mayor for the contract with RV Associates in the amount of $538,000, total Acceleration Change Order The contract includes provisions for a winter shutdown that was to occur from December 1, 2013 to April 1, 2014 to provide the overhead utility purveyors primary access to the site for the Schedule 74 undergrounding between 6 th and 9 th Streets Overall the weather throughout this project has been unseasonably dry, however, several weather delay days have been approved In addition, poor sods were encountered during installation of the deep sanitary sewers which delayed the work These two issues combine to set the current contractual substantial completion date at May 23, 2014, five working days beyond the original contract time and date for the Armed Forces Day parade The contractor (RV Associates) has elected to work during the shutdown to expedite the project and minimize impacts to the local businesses They have requested an $18,000 change order as compensation for all overtime projected to be expended during the acceleration This negotiated change order would only be paid if substantial completion is met by April 18, 2014 Pacific Avenue Fund Transfers and Increase Construction Budget The current approved Pacific Avenue Construction Fund budget is $3,958,674 While the projected total project cost is currently estimated at $3,965,933, the requested action for Council is to increase the budget to $4,100,000 The table ANDREA SPENCER, DIRECTOR, DCD FROM: JEANNIE VAUGHN, BUILDING OFFICIA SUBJECT: ADA COMPLIANCE AT 701 PACIFIC AVE DATE: FEBRUARY 4, 2014 The building at 701 Pacific Avenue is located at the corner of Pacific Avenue and 7` St, and is located adjacent to the sidewalk On August 8, 2013, during the street improvement project on Pacific Avenue, Tom Knuckey asked if I would meet with him to evaluate the conditions of the existing building, which was constructed in 1910 with post and pier foundation During the excavation of the sidewalk, Public Works found plywood was used to cover the posts and infill between the posts The plywood to protect the building foundation system from the soil under the existing sidewalk at some point in the past, perhaps 50 or more years ago Public Works was concerned about how to proceed with the new sidewalk improvements without damaging the building While at the site, we also looked at the front entrance of the building to evaluate the best way to handle the sidewalk concrete work at the front entry The building is constructed on the property line on 7th Street, is approximately 24" from the right - of -way at the intersection, and less than 24" from Pacific Avenue The old sidewalk sloped up to the front door at a slope approximately between 8 and 12 %, with no level landing The existing condition did not comply with accessibility standards, which require a slope of 5% or less and a level landing at the top and bottom of a slope An existing building may have a slope up to 8% Gunnar Fridnksson explained that the sidewalk elevation was predicated on the design of the accessible ramp at the intersection and the elevation of the finished accessible corner plus the 4 -foot, 2% landing at the top of the ramp Constructing a ramp with the proper slope and level landing to the building was not an option The distance from the existing building location to the sidewalk did not allow for a ramp from the sidewalk to the door with the proper slope The sidewalk that wraps around the intersection is required to be at least 5' wide for accessibility, which left very little distance between the building entrance and the sidewalk He asked if accessibility compliance would be satisfied for the building code if the existing concrete was cut to form a step at the edge of the City right -of -way and providing a steep slope from the step to the new sidewalk I replied the 45 degree slope would be more of an impediment and hazard than dust having a step and landing because someone with a walker or cane would have difficulties maneuvering and the slope would be too great for a wheelchair We discussed accessibility requirements for existing structures and the requirement for a level landing on each side of a door The lack of a level landing at the door presents a hazard for egress since occupants are accustomed to walking through a door on a level walking surface The existing slope to the door was not acceptable for accessibility because it did not include a level landing at the door for a person to pause to open the door without having to "hold" their wheelchair or walker in place The step is acceptable as an entrance because the building is an existing building and providing a level landing is more important A ramp with the proper slope and level landing was not an option because the short distance from the sidewalk to the door would not allow a slope less than 8% and a level landing at the door After consideration of the existing conditions and code requirements for ramp and landings, the short landing step at the door entrance was the lesser hazardous and more usable of the two options available while still providing an accessible public sidewalk The step is acceptable as an entrance because the building is an existing building and providing a level landing is more important In this case, the step was the lesser hazardous and more usable of the two options available The building entrance did not have a compliant or fully functioning accessible entrance prior to the Pacific Avenue improvements because the sidewalk sloped up to the building door and did not have a level landing at the door for a person to rest or adjust before opening the door In order to qualify as an accessible entrance, the surface in front of the door could not have a slope more than 1 48 for a distance at least 60" If a sloped ramp is used, a level landing at the top and bottom of the ramp is required Given the existing condition and that the building did not have an existing accessible entrance, I requested Public Works cut the sidewalk as far away from the door as possible to create a landing at the door with a step to the sidewalk The plan of action discussed with Tom and Gunnar was the best we could do with existing conditions On October 24, 2013, 1 was copied on an email from Public Works to the building owner about removing the existing concrete apron at the front door and placing a new concrete apron that would slope from the door to the new sidewalk elevation I replied on October 29 with the Building Code requirements for a level landing at the door and maximum slope for an accessible entrance, and offered to meet with the owner at the site to discuss the existing conditions and the options The owner of the building, Kevin Bernt, met with City staff on site on October 30, 2013, so that we could discuss the entrance to his building He was concerned that his business could not accommodate persons with special needs because of the new design with a step at the front entry I explained that the existing condition was not accessible and discussed the requirements for a level landing at the front door which could not be accomplished with the sidewalk elevations and existing conditions The City has many existing buildings that undergo change of occupancy in which the accessible entrance is not and cannot be provided because of existing conditions The Building Code recognizes that existing buildings may be difficult to retrofit to provide an accessible entrance because of existing conditions An accessible exit is not required in existing buildings The code only requires that existing buildings have accessibility improved up to 20% of the valuation of the improvements in the building construction project when a permit is required If nothing is being improved or modified in the building, ADA upgrades are not necessary except for accessible door hardware Even when ADA compliance is required, the code recognizes that the improvements may not be technically feasible due to existing physical circumstances and allows for partial compliance or alternate methods The building permit for Mr Bernt's business (BB13 00157, approved on March 21, 2013) claimed no improvements to the existing building and only occupancy, therefore, accessibility upgrades were not required Mr Bernt appeared to understand during the meeting that although he thought his building was accessible for his business when he purchased the building, it truly was not compliant, and the landing step option discussed with Public Works staff was the best option with the most code compliant elements Kevin Bernt Compressions for Life 360 - 731 -2507 701 Pacific Avenue Bremerton, WA 98337 02/03/2014 Pacific Avenue Improvement Project 345 6 Street, Suite 600 Bremerton, WA 98337 Dear Pacific Avenue Improvement Project. This letter's intent is to update you on the current conditions that surround my building at 701 Pacific Avenue, in regards to the revitalization project I am all for the revitalization of Bremerton, that is one of the reasons why I chose the location that I did over a separate Silverdale location I wanted to be a part of this process and the improvement of the downtown core Several issues have occurred during this process that are deeply concerning and will affect the community that my building will serve • The ramp that gave access to the front door of the building was removed and replaced by a steep 6" curb type step This is very concerning I recently renovated the entire inside of the building to meet every ADA requirement, however now no wheelchairs are capable of gaining access to the building due to the steep curb My business serves anyone who would like to take a CPR class and help out their community, however due to the step I will be limiting the population that I serve r 9 Pacific Avenue Improvement Project 02/03/2014 Page 2 • My parking lot was used on a daily basis by heavy machinery, trucks, and various vehicles in regards to the project There were multiple times that I had to park on the street and could not park in my own parking lot, because their was no room Due to the fact that heavy machinery was routinely used during the revitalization, the pavement of my parking lot was degraded and heavily damaged. I V + `r fr I included pictures for each issue that occurred because they speak louder than written words can. These issues have caused unneeded frustration and they need to be addressed Thank you for your time, Kevin Bernt Compressions for Life 360- 731 -2507 ' 'A n 7 w g/ o C 7 0A 1 ° ' C9 t R ` 5 U 0 ,o nc 0 t f , ' l "4 '!f' } 77 t i i i tai . j t {l , l t t ' a 9 / rrrA I ° o _ ,, 1 w t • r t 1 t 4 i 1 7 702 Pacific Avenue - Google Maps 702 Pacific Avenue Go®rgle Address Address is approximate Preconstruction 701 Pacific Ave lk -% le N zr e +, _ -, r ' a m . .y ".cg.,...- ,y,' ' j w+'t' i. ✓s t' t 1. t of h ^ '°° o ,A'" at9 d' ' v ° r ' S 4 L QV 71 1r` M P E,1 o P M 7 PI d' t 4 I I I'f I , , 1 +r a a A w { fir '• k.'' a"Py ``° .``::' 1 `` a x: x o a _i +.`'S y ki F v v ra wi py}+,, .
