6D - RESOLUTION NO. 2951 ADOPTING COUNCIL RULES AND PROCEDURES (#AB05-022):
City Attorney ROQer Lubovich explained that the proposed resolution amends and updates the Rules
and Procedures for the City Council by repealing the current Rules and Procedures adopted pursuant to
Resolution No. 2926 and adopting new Rules and Procedures for the City Council to follow in conducting
its business. Notable changes included that there would be no meeting held during the week of
Thanksgiving unless Council scheduled a special meeting to deal with necessary business, removal of a
requirement for second readings of ordinances to align with recent Charter changes, and clarification on
closed record hearing proceedings.
Mike Eliason suggested that Council may, in addition to a decision by the majority, also waive
confidentiality during Executive Sessions by court order. He also discussed how Council may comment
during meetings on businesses in their individual districts. Mr. NVQren suggested that Mr. Lubovich
review the suggestion to determine if it is feasible. Mr. Lubovich stated that we would follow a court
order and that the suggestion would not need to be included.
Ms. Arends, Mr. Shepherd, Mr. McConnell, Mr. Maupin, Mr. GehrinQ, and Ms. Priest offered
comments about Rule 9-13 regarding Council comments on businesses and requested clarification on
what may be considered advertisement and what may be considered comments. The rule in its current
form would not allow promotion of a private business during a Council Meeting. Mr. Lubovich
reiterated that based on the suggestions provided, Council may not advertise businesses in any other
circumstance "except that Council members may make announcements to welcome a new business or
announce special events regarding a private business or enterprise."
Ms. Arends suggested changing the name of the LEGISLATIVE REVIEW COMMITTEE to COMMITTEE OF THE
WHOLE as provided in Rule 2-3. Mr. McConnell and Mr. Maupin agreed with the proposed change and
indicated that the change would be appropriate. Mr. lubovich clarified that COMMITTEE OF THE WHOLE
does not require the entire Council to attend, and that the name only means that all Council Members
are members of that particular committee.
M/S/C/U (McConnell/Shepherd) Move to pass Resolution No. 2951 adopting new Rules and Procedures
for the City Council as amended by the City Attorney (Rule 9-13).
M/S/C/U (Arends/Shepherd) Move to change "LEGISLATIVE REVIEW COMMITTEE" to "COMMITTEE OF THE
WHOLE" (Rule 2-3).
With no further business, the meeting of the City Council was adjourned at 6:03 P.M. Council
reconvened in the Council Conference Room, Room 603 for a LEGISLATIVE REVIEW SESSION to hear
presentations on upcoming agenda items.
