TRANSFER OF IMPROVEMENTS
Kitsap 9/11 Memorial
THIS AGREEMENT is made on the date fully executed below, by the KITSAP 9/11
MEMORIAL COMMITTEE, a Washmgton State 501(c)(3) non-profit orgamzation
("Committee") and the CITY OF BREMERTON, a Washmgton mumcipal corporation ("City")
as follows
RECITALS
WHEREAS, The Committee has constructed and mstalled the Kitsap 9/11 Memorial
consistmg of a limestone block from the Pentagon, sidewalks, plaza, flag pole and related
improvements ("Improvements") m conJunction with the installation of two World Trade Center
Steel Beams owned by the Central Kitsap Fire and Rescue, all located on a certam portion of
Evergreen Rotary Park owned by the City as shown m Exhibit A, attached hereto, and
WHEREAS, the City Council, at its September 18, 2013, meetmg, approved an
Agreement with the Port Authority of New York and New Jersey and the Central Kitsap Fire and
Rescue for transfer of two World Trade Center Steel Beams to the City which were mstalled by
the Committee as part of the Kitsap 9/11 Memorial, and
WHEREAS, the City Council, at its September 18, 2013 meetmg, also accepted transfer
of the Improvements to the City and now the parties desire to memorialize m writmg the transfer
of those Improvements,
NOW, THEREFORE, m consideration of the covenants and mutual promises herem
contamed, the Committee and the City hereby agree as follows
AGREEMENT
1 The Committee does hereby assign, transfer and set over to the City ownership of
the Improvements installed in con�unction with the two World Trade Center Steel Beams
2 The City does hereby accept the transfer and ownership of the Improvements from
the Committee mstalled ui con�unction with the two World Trade Center Steel Beams
3 Each person sigmng this agreement acknowledges that he or she has the authority
to execute this agreement on behalf of said organization
4 This agreement may be executed m two or more counterparts, each of which shall
be deemed an origmal and all of which taken together shall constitute one and the same
mstrument
IN WITNESS WHEREOF the parties hereto have caused this Agreement to be executed
on the date noted below
