AMENDMENT TO LEASE AGREEMENT BETWEEN CITY OF BREMERT4�ommumry Dcvelopment
AND AUTOMOBILE CLUB OF WASHINGTON
WHEREAS, The City of Breznerton ("the City") and the Automobile Club of
Washmgton {"Lessee"), coliectrvely "the Parties" entered trito a lease agreement on
March 7, 1986 ("the Agreement") whereby the City leased a portion of its right of way to
Lessee;
WHEREAS, Part B, Section 12 of the Agreement authorizes #he Parties to amend
the Agreement,
WHEREAS, the Parties mtend to amend the A�reement to allow Lessee and other
businesses located in the same buildxng as Lessee to erect signs ident�fying fi�ieir
busmesses within the Premises pursuant to the limitat�ons, restrictaons, standards and
procedures set forth in the Bremerton Municipal Code ("BMC");
THEREFORE, for good and valuable consideratton, the Parties hereby amend the
Agreement as follows•
1 Part A, Section 2, is amended as foilaws: "Lessee shall have the use and
occupancy of the Premises for the sole purpose of constructing a sidewalk, curbs, gutters,
pazking area and landscaped azea, includmg maintenance, and for placement of a sign
identifying its busmess, and for no other purpose. Lessee must follow the procedure for
erectmg a sign pursuant to the BMC, including obtaining a permit and approved final
inspection, and the sign must conform to the standards, limitataons and resirictions set
forth in the BMC " '
2. Part B, Section 1, is amended to include the following at the end of the
section: "EXCEPT THAT, Lessee may sublease ox assign a portion of the Premises for
the sole purpose of allowing a business to erect a sxgn within the Premises identifying its
busmess; PROVIDED THAT, a) the business is located within the Lessee's building
adjacent to the Premises, b) tlie Lessee, or sub-lessee, follows the procedure for erectmg a
sign pursuant to the BMC, including obtaming a permrt and approved �nal mspect�on,
and c) the sign canfarms to the standards,l3mitations and restrictions set for�h in the
BMC.°'
3. Any other portion of the Agreement that is in conflict the above
amendments or the Paxties' express intent in amending the Agreement as set forth above
is hereby amended to be consistent vv�th the above amendnnents and the Parties' antent.
