LICENSE TO MAINTAIN LANDSCAPE PLANTER STRIP IN SIDEWALK
This Agreement is made between the City of Bremerton ("City") and � p�,e, � C'Jl,t,s li'lC `'S �SS�'
("Owner") for construction and maintenance of landscaping planter areas wrthin the sidewalk
abutting Owner's property
The Crty is currently constructmg road and sidewalk improvements ad�acent to Owner's
property and the current plans call for installation of concrete sidewalk m the area in front of
Owner's property '
2 Owner desires that a portion of the concrete sidewalk be set aside as a landscaped planter
area rather than covered in concrete as depicted in Exhibrt A, attached hereto
3 For valuable consideration, the parties agree as follows
a City will construct the sidewalk as designed in the improvement pro�ect except
that rt will remove the provision for pourmg concrete into the section identified m Exhibit A as a
landscape plantmg strip in the area that abuts Owner's property
b Owner will be solely responsible for planting, watering, and maintaimng the
landscape planting strip and shall not allow the planting strip to become overgrown or create any
type of hazard to the public Owner shall also ensure that the landscape plantmg strip is kept
clear of garbage and refuse
c City retains'the exclusive right to take any action rt deems necessary to preserve
the landscape planting strip, protect the public or protect Crty-owned property m the event
Owner fails to maintam the landscape planting strip This may include, but shall not be limited
to, pourmg concrete and eliminating the plantmg strip In addition, the City retams, at rts sole
discrehon, the exclusive right to remove, m whole or in part, the landscape plantmg stnp and/or
mstall any other improvements rt deems necessary
