SUMMARY The City has completed remedial construction as required under Agreed Order DE-
07TCPHQ -5024 at the former Chevron property Per the terms of the order, the City is committed to
on -going groundwater monitoring until contamination levels drop to MTCA A levels — for planning
purposes this is estimated to be achieved in 5 -years Ecology has requested the City execute a
second Agreed Order (DE- 12TCPHQ -9509) which quantifies monitoring and reporting requirements
The second Agreed Order makes the City eligible to expend grant funds for the first year of
monitoring The requested action is approval of Agreed Order DE- 12TCPHQ -9509

FISCAL IMPACTS (Include Budgeted Amount) The 2012 budget is $80,000 and the 2013
requested budget is $30,000 Projected 2013 expenditures will exceed the budget, therefore, a mid-
year budget adjustment is anticipated
