LICEN5E AGREEMENT

THIS LICENSE AGREEMENT, hereinafter referred to as "Agreement", rnade and entered into
between the CITY OF BREMERTON, whose address is 345 Sixth Street, Surte 600, Bremerton
WA 98337, hereinafter referred to as"Crt�' and Was}ungton State Patrol, heremafter referred to
as "Licensee"
NOW, TI�REFORE, m considerahon of the terms, condrtions, covena.nts and performances
contained herein, IT 1S MUTUALLY AGREED AS FOLLOWS
1 DESCRTPTION OF PREMIS�S The City hereby ieases to the Licensee the
followuig described premises for up to thirty (30) days m any calendar year.
FIRING RANGE located 1 /4 mile north of the Gold Mounta�n Golf Course an the
old Belfazr H'ighway, 6581 West Old Valley Road, Bremerton, Was}ungton 98312
Licensee acknowledges that the City and other licensees use the Premises Days of use shall be
scheduled thirty da.ys m advance and will be accommodated on a first scheduled basis.
2. TERM: Tbis agreement shall become effective on January 1, 2013 for up to one
yeaz, and ending on December 31, 2013 This agreement shall automahcally be
renewed on a calendar year basis unless wntten not�ce of termmation is groen by either
party by the �rececung month of any such year
3. RATE: The Licensee shall pay the crty for use of the premises at the followmg rate:
One Hundred Dollars and No Cents ($100 00) per day, in advance.
4. EXPENSES: Licensee shall supply all weapoxzs, ammuiutron, targets and other
supphes used xn the target exercise.
5. MAINTENANCE AND REPAIR: The Ciiy shall, unless herem specified to the
contrary, maintau3 the premtses in good repair and condition dunng the cnntinuance of
tkus agreement, except in case of damage arising from the neghgence of the Licensee's
agents or employees For the purposes of so masntauung the premises, the Crty
reserves the nght, at reasonable times, to enter and mspect the premises and to make
any necessary repatrs to the building Licensee shall clean np all �arba�e and debris
after use.
6. TERMINATION: This agreement may be terminated by elther party, rvrthout cause,
by g�.ving written nohce of not less than thuty (30) days pnor to the effechve date of
the terminat�on Pro-rata refunds for the remauung pre-paid rental term shall be
refunded to Licensee should either party uutiate ternunation.
7. RANGE SUPERVISION: Lxcensee sha11 provide and reqture the presence of a
qualified range officer at all times dunng wluch the Licensee's personnel aze using the

premises To assure safe operations, the Licensee's range officer sha11 have full
authonty and responsihility to dzrect the achvihes of those using the range and shall
halt any act�vity found to be unduly hazardous.
8. HOLD FIA�L1vIT_FSS: It �.s understood and agreed that this agreement is solely for the
benefit of the parties hereto and gives no nght to any other party No �omt venture or
par�erslup is formed as a result of this agreement Each party hereto agrees to be
responsible for rts own acts or omtssions, or those of rts officers, agents, or employees,
and agrees to save, indemrufy, defend, and hold the other pariy harmless from any such
habilrty In the case of negligence of both the Crty and the Licensee, any damages
allowed sha11 be levied m proporhon to the percentage of negligence attributable to
each party, and each parry shall have the nght to seek contnbut�on from the other party
m proportion to the percentage of neghgence attnbutable to the other party
