Bremerton City Council From: Mane Vila, CDBG /HOME Administrator Date October 17, 2012 Re: 2013 Funding Recommendations and Action Plan On May le, 2012, the City Council approved the 2013 CDBG / HOME Policy Plan which outlined the funding allocation process and included CDBG rules and regulations The Policy Plan also allocated funding for CDBG and HOME Administration, and targeted 10% of the available capital funding for economic development. All other funding is allocated through a competitive application process The competitive application for 2013 funding was conducted through the Coordinated Application process, which was adopted in 2011 to streamline the grant allocation process for City and County Block Grant Programs, and KRCC Homeless and Affordable Grant Programs For 2013 funding, the Coordinated Application was completed and submitted online through a 3' party vendor tool Applications were due June 29, 2012 Received were • 18 CDBG Capital Applications • 33 Non - Capital Applications (public service, operations and maintenance, rental assistance) Applications were screened by Coordinated Application staff for completeness, eligibility and agency capacity, and by the Kitsap County Auditor for financial compliance and capacity All applications were individually reviewed and scored by each Grant Recommendation Committee member, then interviewed, ranked and evaluated again as group Staff provided guidance as to which projects qualified for the different funding pots based on factors such as the project activity or geography Through this evaluation process the Grant Recommendation Committees developed the funding recommendations attached here Highlights • Recommendations comprise 4 Capital projects, 1 Economic Development project, 2 HOME projects, and 3 Public Service projects • The targeted Economic Development funding is allowing KCR to partner with Washington CASH in order to preserve this valuable program in our community • 2 brand new applicants were recommended for funding • Recommended housing projects will create 3 new units, rehab 4 affordable, special needs units, and weathenze approximately 7 low- income, homeowner units • 2 projects will create or enhance public facilities (Walker Park, ADA Curbcuts) Funding trends for 2013 • The Coordinated Application process has resulted in 1) fewer grant contracts for each granting jurisdiction, and more targeting of certain grants to particular needs (most homeless need is addressed through KRCC Homeless Housing Grant, for example) • Services The GRC's first goal was to fully fund all food programs, such as food bank operations and senior nutrition programs • Capital GRC focused on funding projects that met feasibility /readiness cntena, in combination with agency capacity to cant' out the project Other considerations factored in were size of the population impacted, and prior CDBG or HOME investment • Public Comment Received as of 10/16/2012 (additional comments will be provided prior to PH) 1 Inland Empire Residential Resources (IERR) submitted a comment requesting reconsideration of its project "Frances Haddon Morgan Replacement Housing ii ", which was not recommended for funding (Please note "FHM Replacement Housing I" received an award of $100,000 in 2012, and a recommendation for Kbap County HOME funds of $40,925 for 2013) DSHS submitted a comment on behalf of IERR in support of "FMH Replacement Housing II" 2 Kdsap Mental Health Services expressed thanks for recommending funding for their "Scattered Site Rehab" project 3 Westsound Treatment Center submitted a comment expressing "senous concerns" about the KRCC's large set -aside of Homeless Housing Grant Program funding for the Housing Solutions Center operations 4 YWCA submitted a comment regarding not receiving a recommendation for funding for their "Operations & Maintenance" or "Legal Advocacy" projects (Please note funding in the amount of $10,000 from KC CDBG was recommended for "Family Services) A 30-day public comment period was opened via legal notice in the Kdsap Sun, running from September 21 through October 22, 2012 All comments received during this period will be provided to Council for consideration Recommendations for award to be funded by City of Bremerton CDBG or HOME programs will be presented to Council for approval on November 7 in a public hearing All other award recommendations will be considered by the KRCC All funding approvals are contingent upon estimated 2013 funding from the Department of Housing and Urban Development (HUD), availability of reallocated funds from previous years, and program income The Grant Recommendation Committee has developed funding contingency provisions in case the City receives more or less funding than anticipated If approved, these funding recommendations will be submitted to HUD in the 2013 Annual Action Plan, due to HUD November 15, 2012 Should you have any questions or concerns regarding any of these items please do not hesitate to contact Mane Vlci at (360) 473 -5375 Staff Memo - IERR is making a 40 -year commitment to maintain the housing for people with developmental disabilities and to set rent at 30% of a person's income including utilities IERR has applied to the State Housing Trust Fund for $868,000 that was identified in legislation to support this project. C 0 M Kitsap Regional Coordinating Council P 0 Box 1934 Kingston, WA 98346 Attention Kirsten Jewell RE Public Comment Submission from West Sound Treatment Center Kirsten I wanted to personally thank you for reminding the community at the Housing Solution Center meeting last week that the Housing Solution Center and Kitsap Community Resources are not necessarily automatically entitled to receive HHGP and AHFA funds I have had SERIOUS concerns about the earmarked "set- aside" dollars The last couple years have been very lean for West Sounds programs and for many other smaller community agencies While our agency is small, it has a substantial and lasting impact on our community Last year alone, we provided more than 17,000 bed days for chronically homeless individuals and families and more than 15,000 hours of direct service to 1,400 low and no income participants it seems fair that we (and other community agencies as well) should also be able to "earmark" dollars for set -aside and that the Housing Solution Center should be accountable for seeking outside funding sources like everyone else I understand the Central Intake system is necessary and required and it has been helpful to the community We have our vacancies listed on the HSC website but their actual intake function has not in fact, served our participants in anyway that is substantially different than calling our own front desk, and we continue to complete our on -site intakes at our facilities because they not only build important rapport with our clients, but they also gather pertinent and mandatory data to clinically diagnose and refer our participants to the appropriate level of treatment and mental health care, which the HSC is not licensed or qualified to do Thank you also for making the point that central intake system agencies in other counties have indeed been required to, and have successfully gained, funding for operations outside the HHGP and AHFA to operate and maintain their programs, thereby not depleting important local funds that are needed for housing and human service providers While West Sound does not feel entitled each year to the receiving of the HHGP and AHFA funds, housing and human service programs in our community including our own have taken a big hit financially due to the earmarking of $200,000 to operate the Housing Solutions Center and my biggest concern is that our housing and human service programs won't be able to sustain their current operations should the large amount of "earmarked" dollars continue to go to the HSC We are expected to secure outside funding for use as valuable leverage for our programs and the Housing Solutions Center should be held by the same requirements I am troubled that the HSC will be hard - pressed to refer those most in need of housing if our community housing and human service programs go away due to the inability to access our Imperative local funding These are tough times for all and it is important that each agency including the Housing Solutions Center do their part in seeking and securing a diverse funding base in an effort to keep our community programs alive Respectfully, Robin O'Grady, Executive Director This information has been disclosed to you from records whose confidentiality is protected by law Federal regulations (42 CFR, Part 2) prohibit you from making any further disclosure of it without the speck written consent of the person to whom it pertains, or is otherwise permitted by such regulations A general authorization for the release of medical or other information is not sufficient for this purpose r i YWCA Community Center eliminating racism 905 Pacific Avenue - PO Box 559 em powenng women Bremerton, WA 98337 Phone (360) 479 -0522 a of Kitsap County Fax (360) 479 -0484 Email info @ywcakitsap.org Website: www.ywcalutsap.org October 16, 2012 Bremerton City Council c/o Marie Vila Bremerton Community Development Block Grant Program 345 6" Street Bremerton, WA 98337 Subject- City CDBG Funding Denial Dear City Council Members - The Board of Directors of the YWCA of Kitsap County has directed me to submit a letter to you urging the City Council to reconsider the Grant Review Committee's denial of the YWCA's request for financial support for Legal Advocacy Services for survivors of domestic violence who, due to the trauma and other dynamics in domestic violence events, are unable to meet the crisis and safety needs of themselves and their children. Fear for their lives and their children's lives often dominates their thinking during the immediate crisis, and the legal advocate is able to empower the survivor to make choices that are best for the safety and well being of herself and her children. Legal advocacy has become even more important as YWCA Legal Advocates grapple with issues that are very complex, ranging from immigration to orders of protection, and child custody decisions. The growth in Spanish - speaking populations has dictated the need for bilingual legal advocacy services. In fact, the YWCA is one of the first agencies in the county to offer bilingual services to ensure that the needs of all women and children in crisis could be met. Our capacity to assume this role was due largely to the integrated service model we shared with the former El Centro de la Familia, and currently continues in cooperation with the Kitsap Immigrant Assistance Center Without these important services, an entire segment of our county's population has less opportunity to participate confidently in the justice system. Community Development Block Grant funding plays an important role in the complex sustainability puzzle of our Legal Advocacy program. We must continue to demonstrate to other funders and stakeholders that our community supports our efforts. While our request for support from CDBG is relatively small, it allows for value -added opportunities to leverage funds from other sources while legal advocates do the important work of promoting safety in the home, assistance throughout judicial proceedings, and opportunities to mitigate landlord - tenant challenges in gaining access to permanent housing Our Board has had the distinct pleasure of consulting with the Nonprofit Finance Fund. Consultants from San Francisco and Detroit met with staff and board to devise a plan that allowed our staff and stakeholders to identify strengths and weaknesses in our funding model. Our Board of Directors is in the process of implementing a new plan which affirms the need for further diversification of our resources and maximizing assets while building stronger donor engagement as the best strategies to foster financial health. These strategies will take time to become fruitful, and I find that at this time 1 must ask you to please analyze the rationale for the decision to deny funding to a program such as Legal Advocacy that is desperately needed by an average of 60 percent of our organizations' participants. Ultimately the program reaps a savings to government. C " To thrust our collective power toward the elimination of racism wherever it exists and by any means necessary " ' © Unacu 41 dy Agenc; I would be grateful for your thoughtful re- consideration of our request for Legal Advocacy for survivors of domestic violence dunng these turbulent financial times. City is an entitlement community —we receive CDBG funding every year because HUD has determined we qualify based its formula (number of persons in poverty + aging housing stock). HOME funding comes through the Kitsap County HOME Consortium. HUD has determined that Bremerton is entitled to 43% of the County's HOME award. 2. Certain requirements: a. Planning process - 5 -year Consolidated Plan and its components: i. 5 -year Consolidated Plan Council approved every 5 -years in a PH. • Community Assessment • Housing Market Analysis • Strategic Plan —includes goals and strategies for the 5 HUD identified target areas ✓ Housing ✓ Homeless ✓ Community Development ✓ Economic Development ✓ Special Needs. • Citizen Participation Plan n. Annual Action Plan -to inform HUD of the activities we plan to fund with following year's allocation. Council approved each Autumn in a PH. iii. Consolidated Annual Performance and Evaluation Report (CAPER) —to report to HUD the accomplishments of the prior year's funded activities This is advertised for public comment, but Council approval is not required. b. Policies and Procedures - annual Policy Plan, NOFA. Council approved each Spring in a PH. The grant application is guided by the policies but,not subject to Council approval 3. Certain limits on use of funds: Staff relies on Code of Federal Regulations to run the program. Many regulatory topics are addressed in the City's Policy Plan, such as funding caps. CDBG Funding Caps: HOME Funding Caps: Administration: 20% Administration: 10% Public Services 15% CHDO (minimum): 15% Capital /ED no cap Capital: no cap 4. Discretionary Policies: such as coordination w Kitsap County on Consolidated and Policy Plans; coordination w/ Kitsap County and KRCC on Coordinated Application. These policies aim to save staff time and effort, and the latter may impact what the city is funding. This year, the July over July IPD is 1295% The attached ordinance recommends increasing both the general property tax levy and the EMS levy the full 1% as allowed bylaw However, the EMS levy is also subject to the $0.50 per $1,000 of assessed value cap, which limits our EMS collections for 2013. The attached ordinance also reauthorizes the tax collection to pay the debt service associated with the voter approved Public Safety bond ATTACHMENTS: 2013 Tax Year Levy Limit Calculations (from Kitsap County Assessor's office) Ordinance No 51 R 7 establishing the amount to be collected in 2013 by taxation on the assessed valuation of taxable property within the City limits of Bremerton and setting the property levy rate FISCAL IMPACTS (Include Budgeted Amount) The proposed 2013 Budget anticipates passage of the attached ordinance ® APPROVALS: DEPARTMENT DIRECTOR CITY ATTORNEY FINANCE DIRECTOR MAYOR RECOMMENDED MOTION: Move to approve Ordinance No. 5 1 917 levying property, EMS, and public safety debt service taxes for collection in fiscal year 2013 No action required on the revenue sources portion of the public hearing — public comment only. Presenter Becky Hasart Phone: 473 -5722 SUMMARY: The proposed ordinance amends Section 2 03 010 of the Bremerton Municipal Code to reduce the Mayor's salary and eliminate the cost of living adjustment ATTACHMENTS: Proposed Ordinance. Ao, 519 9 FISCAL IMPACTS (Include Budgeted Amount). BMC currently has the Mayor's salary at $122,424 with a COLA tied to that which the Teamster's would receive There was no COLA adjustment for 2012 and no adjustment for 2013. The incumbent Mayor is currently receiving $116,560 ($122,424 less her donation back to the City of $5,864 — equivalent to 12 furlough days) Because there is no COLA adjustment for 2013 and because the proposed ordinance would not be effective until January 1, 2014 (with the next election cycle), there is no fiscal impact for either 2012 or 2013 In 2014, the potential impact would be a $15,424 yearly savings based on the full $122,424 current salary APPROVALS: DEPARTMENT DIRECTOR CITY ATTORNEY FINANCE DIRECTOR MAYOR.
