7A — ORDINANCE NO 5192 GRANTING A SIX (6) MONTH EXTENSION ON THE EXISTING
MORATORIUM FOR MEDICAL MARIJUANA COLLECTIVE GARDENS Allison Daniels
Community Development Department, emphasized that the action before the City Council is to
conduct a public hearing and enact a six (6) month extension to the existing moratorium for all
applications and permits for medical marijuana collective gardens The current moratorium is
set to expire on August 31, 2012
She established that the City Council first enacted a moratorium on this issue on September 1,
2011 (Ordinance No 5159) and passed an extension on February 1, 2012 (Ordinance No
5178) The City Council enacted the moratorium because the Bremerton Municipal Code (BMC)
does not adequately address the placement of medical marihuana collective gardens and the
impacts to the community that these uses may present
Staff if requesting that the City Council pass the six (6) month extension to allow adequate time
to research other jurisdiction's code amendments and related court cases Staff will utilize this
information to develop a set of recommendations for the Planning Commission and City Council
to contemplate as changes to the BMC are considered for addressing medical marijuana
issues

MUNICIPAL CODE (BMC) "EMPLOYEES INCLUDED IN CIVIL SERVICE" TO REMOVE THE
POSITIONS OF FIRE CHIEF AND CHIEF OF POLICE FROM THE CIVIL SERVICE SYSTEM
Becky Hasart Financial Services Director, pointed out that the current provisions of the
Bremerton Municipal Code classify the positions of Fire Chief and Chief of Police as Civil
Service positions The proposed ordinance removes these positions from the City's Civil
Service System
Mick McKinley former Assistant Fire Chief, hoped Council would not support these changes
because it would subject the Chiefs to political motivation, and called this move a power grab
Todd Best believed that department heads are part of the Mayor's cabinet, and hoped this
change would help improve morale among departments

8C — ORDINANCE NO. 5191 PROVIDING FOR THE ISSUANCE OF LIMITED TAX GENERAL
OBLIGATION (LTGO) REFUNDING BONDS FOR THE BBREMERTON] NORM DICKS
GOVERNMENT CENTER, AND DELEGATING AUTHORITY TO THE DIRECTOR OF
FINANCIAL SERVICES TO APPROVE THE FINAL TERMS OF THE BONDS Becky Hasart
Financial Services Director, explained that in 2003, the City was a partner with Kitsap County
and Housing Kitsap in issuing bonds for the purchase and development of the Bremerton
Government Center, more commonly known as the Norm Dicks Government Building These
bonds can begin to be redeemed on July 1, 2013 Based on current favorable interest rates for
municipal bonds, the City can choose to issue bonds this year to be held in escrow for
redemption beginning July 1, 2013
In addition to the favorable bond market for interest rates, it is in the City's best interest to be a
small issuer under the IRS code and designate the bonds as "Bank - Qualified" To do so, we
may issue no more than $10 million in bonds in any given year This issue should be a little

below $6 million The City anticipates having to refinance its line of credit for its parking debt
during 2013, which will be approximately $9 million As such, the City would not be in a
position to refund the government center bonds in 2013, and retain the small issuer "Bank -
Qualified" designation
The proposed ordinance delegates to the Director of Financial Services the ability to set the
date and rates for the final sale of the government center bonds The ordinance sets the
parameters under which this can occur By doing this, the City can watch the market for any
signs that the interest rates are starting to climb If that were to happen, we can move quickly
without being tied to a date certain based on Council meeting schedules
There were no comments from the public
07 17:30 Motion to approve the ordinance was made by Brockus, and seconded by Runyon
