SUMMARY: The action before City Council is to conduct a public hearing and enact a six month
extension to the existing moratorium for all applications and permits for medical marijuana collective
gardens The current moratorium is set to expire on August 31, 2012
The City Council first enacted a moratorium on this issue on September 1, 2011 (Ordinance No
5159) and passed an extension on February 1, 2012 (Ordinance No 5178) The City Council enacted
the moratorium because the Bremerton Municipal Code (BMC) does not adequately address the
placement of medical marijuana collective gardens and the impacts to the community that these uses
may present
Staff is requesting that the City Council pass this six month extension to allow adequate time to
research other jurisdiction's code amendments and related court cases. Staff will utilize this
information to develop a set of recommendations for the Planning Commission and City Council to
contemplate as we consider changes to the BMC that address medical marijuana issues

development permit or approval for Medical Marihuana Collective Gardens.
