SUMMARY: As part of the Park Avenue downtown redevelopment project the City converted
overhead utilities to underground utilities Pursuant to RCW 35 96 050, when the underground
utilities are available for connection the City must mail notice to adjoining property owners that they
must convert such utility service lines from overhead to underground within 90 days after the date of
mailing of the notice On May 30, 2012 the City mailed such notice to the adjoining property owners
RCW 35 96 050 also provides that if the owner files a written objection to the utility conversion within
30 days from mailing of the notice the City shall schedule and conduct a hearing to determine
whether such conversion is in the public benefit Three adjoining property owners have filed a
protest The purpose of this hearing is to consider the protests and determine whether or not the
removal of services and conversion of utilities from overhead to underground pursuant to RCW
35 96 050 is in the public benefit
